With regard to Home Owner Associations, now they're putting up a security gate when you drive into the development for the purpose of safety. To cover the cost of this thing (which was vote on by the board members and not the actual home owners themselves), they are charging $147.50 per access card!

I looked into some of the suggestions in the other trend but no seat on the board is going to open up until 3/2002!

A person moves his family into a nice house in a nice community and it's being spoiled by this kind of craziness! I'm seriously thinking about moving even if it means having to sell the house at a loss.

Try public shunning and humiliation. I know some of the things *I* would do - but it's not fit for public discussion.

I think you need to make the board members stand by the gates during the morning and evening fuster cluck so youse residents can wave and show them your appreciation.

It's a shame, but many of the people that these boards appeal to are professional busibodies and pecksniffs who have no life so they must insinuate themselves into yours. It's the only power they've ever had and they will eff you over every time. If they can't be reasoned with, perhaps it's time for teh residents for form up an ad hoc committee and get a lawyer? The actual access card doesn't cost that much but they have to raise the money to pay for the building of the gate system and the only way that they can raise money is to build it into the cost of the access card.
 
That gate will have an emergency acess code that is given to PD/FD/EMT's, I'm sure you all know one of those professionals.

Sigh....our fee was 215.00...and that doesn't include how much they increased the dues for maintenence and all that crap. Wouldn't need to pay for so much maintenence if they had gotten a gate that worked. :rolleyes:

Then the HOA cut down all the trees...sigh...
and put in big ugly speed bumps...sigh...and raised the dues again!

And we won't talk about what happened when I tried to negoiate getting thru the security gate on my new bike...suffice it to say I look good in black and blue.

Oh, and forget about the PD/FD/EMT's having a code...so does UPS, the mailman...the paperboy...sheesh...they should call it an insecurity gate...or an unsecurity gate...

I think it is time to move.
 
FUD - Have you thought about contacting one of the members of the board? I'd think about getting petitions signed by your neighbors and presenting them to a board member. Make 'em think that they "represent" you, like a congressman.

Also, pay a contract attorney to look through the rules and regs for loopholes. You might find something that could get you out of your obligation to the rules.

If not, do like RAE suggested in the other thread: Stretch every rule you can, don't break them, but stretch the hell out of 'em. Get creative in finding ways to pi$$off the board. Appeal every fine and if they won't remove it, then take them to small claims court to recover the costs of their fines. They'll end up leaving you alone if you present a reasonable alternative to their unbreakable rules.

I think George is on to something there. You know some mechanical devices do tend to malfunction so much that they just get scrapped and forgotten.

I just recently installed such a gate, and I can give you the universal pass-card to just such a gate: A big iron pipe. Yep, if it is like most auto gates, there will be a place in the pavement that is cut out. Probably a six foot rectangle, where there is a safety loop installed. The purpose is that the gate will not close on a vehicle entering or leaving. Just keep a 2" X 3' pipe with you, and roll it over the other side of the loop in the pavement. That should open the gate unless they got a high-fallutin' one that has special security measures. This gets me into most gated communities at will. There are a lot of these popping up around here, so it was by necessity that I learned to defeat them.
 
Consider the cost of tools which could easily, quickly and quietly disable the gate and add the penalty for getting caught.

Is it less than a thief could afford?

Stop and take a deep breath. Go out and shoot a few rounds at the range. Ideals are great until they cripple you in the wallet with zero hope of return. Daydreams of destroying the gate are fine, but back to reality for a second here. If the gate is destroyed, or you fail to ante up, is the HOA going to assess you via the esgrow account? I would think they would, given the other info you provided. So in the long run, if you fail to pay the $147.00 fee, they are going to get it anyhow, and quite possibly with a lein that could screw up future sales plans. Destroy the gate and who pays? Some fights are best fought by walking away. In the short term, enjoy your new house, think of it as "apartment living with a twist" and look foreward to owning a real home. The only thing people are more willing to share than opinion is spending other people's money, ya know? Think about it, is it worth it? It sounds like you got conned. Too bad it sounds like it's a legal scam. I may sound like a weenie compared to other posts, but ya know what? TFB. I could sit here, a thousand miles away, and type *MOVE NOW* and it would cost me nothing. Live, learn, and move on, better for it. 'sides, if you take a beating, think of all the guns you can't buy ;) It sounds like you made an unwise purchase, based solely on you desire for personal freedoms. Don't compound it by making a rash finacial decision. Anywho, thanx for sharing the experience. Think of it as a home-buying-mugging, and next time, be a bit more home-buying-tactical.
My wife and I are currently looking at some new housing, and a lot of the houses we see are in such associated living communities. I for one have learned from this thread to avoid them. For that, I offer you thanks.
 
I moved from NYC to get away from big city people. When my father moved to Florida, he bought in a gated community. Well, guess who lived there. The same people from the big cities who brought their idiotic ideas and problems with them.
When I was looking for a house here, I specifically told the real estate no planned communities. I visualized the problems that you`re having. Plus, you wind up paying taxes twice. Once to the county and once to the assn. for maintenance and "protection". Meanwhile, the losers live inside the gate!
I live in the town limits for one reason. We have full time police and ambulance service. I have a heart condition and while I`m capable of protecting myself and my property, I can`t treat heart attacks.
I`d rather have bought some acreage in the county where I could shoot on my own property whenever I felt like it. Except for this restriction, I`m pretty satisfied with the way things worked out.

I'm sorry if this sounds like a stupid question, but WHY the hell do you people live in these places? A friend of mine had a condo in one, and told me all the horror stories.

My reaction: legalized communism. Why subjugate yourself to an American mini-KGB? I thought this was the land of the FREE. When we bought a house, it was in a REGULAR residential area. No funny little papers to sign. Which is good, because I would've walked out and left them at the signing table.

These "COMMUNities" only exist because SAPS choose to live there. Otherwise, they are called GHOST TOWNS.

If you don't like it MOVE THE HELL OUT! Man, you shouldn't have bought there in the first place. So, pardon me, but you get NO SYMPATHY from this end. Get out or PAY UP, and enjoy your commie lifestyle. You're adults. No excuses. Period.

Be the biggest pain in the a$$ you legally can be. Make them cross to the other side of the street whenever they see you approach. Maybe they will buy you out at a profit just to get rid of you. Don't get mad, get even. RAE, bending over and dropping you pants only gets you what you know is coming.
