DAYTON, Ohio (AP) -- A restaurant owner shot three men, killing one and injuring at least one other, as they fled his business
after a robbery Saturday, police said.

The men entered Falb's restaurant, a mom-and-pop business on Dayton's north side, shortly before noon. They split up, sat at
the counter and ordered food, said Sgt. Donald Britton.

The men eventually converged on the owner. Armed with handguns, they took him into a back room and emptied a safe, then
emptied the cash register in the restaurant, Britton said.

As the suspects walked toward the exit, the owner grabbed his shotgun and fired one shot inside the restaurant, Britton said.
There were 12 to 14 patrons inside at the time, he said.

All three suspects fled and the owner followed. Once outside, one of the suspects apparently turned and pointed a gun at
owner, who fired several shots, Britton said.

The suspect who pointed the gun died at Grandview Hospital, Britton said. Police caught a second suspect, who was shot in
the shoulder. Police were searching for the third suspect.

The names of the restaurant owner and the suspects were not released. Britton declined to say if the restaurant owner would
face charges.

Police found guns, money and food in an alley near the restaurant.

Funny thing, BGs often think mom & pop type establishments are easy targets. Mom & pop places, however, are the ones most likely to be armed and to fight back. The regular clerk in a 7-11 is only to happy to give up corporate money, but mom & pop are fighting for their lives and livelihood. The upgrade to the gene pool is appreciated.
 
I hope that someone will follwow this and report what the out come is for the restaurant owner. Will the city attorney decide to charge the owner with some offense or deicde that he was fully justified? As in the schools I believe that some public officials are accepting a zero tollerance status.
 
I wonder if he is going to be charged with being robbed and held at gunpoint. Don't know about shooting inside establishment with people there, but then again, I couldn't see where those people where positioned. Did a good job IMO. Well, except for the shoulder injury :D
 
Shotgun in a crowded room is sometimes OK (consider that a choked barrel with birdshot won't create a particularly large hazard zone...maybe 5" at 10ft.) and it worked fine this time.
 
While I sympathize with the restaurant owner, if this incident occurred as reported here, this guy is in deep doo-doo.
Once the robbers turned to leave and started to head out the door the threat of physical injury or death essentially ended, as well as the justification for the use of deadly force in self defense.
By following them outside he further complicated his case.
Unless some new facts subsequently emerge, I'd be very surprised if they don't send this guy to prison.
 
I agree. You can't follow AFTER an attack is over, and the immediate threat to your life (or the lives of inncents near you) is over. Only the police have that job.

Shoot to defend = okay

Shoot to punish = vigilantism

My opinions only.

A little vigilanti-ism, every now and then, is a good thing.
 
I'm not so sure you're right guys. I believe it largely depends on why he said he followed them out the door. The story says he shot the man after he pointed a gun at him. If he said he followed them to identify the car and plates I say he probably walks. I think they will have a tough time persuading the Grand Jury that he broke the law following them out the door or any where else he may have chosen to follow them. ( "I only carried the shotgun out the door with me in case they tried to hurt me. I only fired at them outside once he pointed a weapon at me." ) If he said he followed them out the door to try to stop them or with the intention of shooting them then I agree, he's sunk. Just my opinion.

Dayton is a pretty liberal town. I'd consider the gentleman's chances as 50-50.

Man who killed robber: I had no choice’

The Cleveland jewelry store owner who shot to death an alleged armed robber on Thursday says there was nothing else he could do.
"Of course I feel bad about it, but I had no choice. I was afraid he was going to kill my wife," said Alexander R. Loevsky, owner of the Jewelry Island, 4115 Lee Rd.

Loevsky said he responded to screams from his wife, Irene, and fired at the man three times inside the store. He said he called 9-1-1 after he followed the man into the parking lot and saw him collapse.

Joseph Means, 25, of Cleveland, died from a gunshot wound in the upper chest and suffered two other wounds, to his ear and face, Cuyahoga County Coroner Elizabeth K. Balraj said.

Loevsky disputed a witness’ statement that he shot Means in the parking lot. He said he fired only inside the store.

Police kept Loevsky for questioning but released him Thursday night. A police spokeswoman said prosecutors will determine whether to file charges.

Loevsky said yesterday that it would be unfair if he was charged with anything.
Irene Loevsky said her husband acted appropriately.

"He came to rob and kill me," she said of Means. "We did what we had to do."
The couple said Means had purchased jewelry from them previously and that they had known him for about five years from around the Lee Harvard Center, where the store is.

Irene Loevsky said Means pulled a knife on her, punched her to the floor and then started grabbing handfuls of jewelry. She said he saw her husband come out with the gun but didn’t drop the jewelry.

"The gold for him meant more than his life. That’s all he cared about," she said.
