David Boies misconduct: Any consequences?

Amid all the celebration over finally deciding the election, I have not heard word one regarding action against Gore atty. David Boies, who, if you recall, misrepresented Illinois legal citations (dimpled chads), which was the basis for the whole recount fiasco...

"Dduh, your honor, yes I know we're a $600/hr law firm with state of the art research computers and paralegal staffs.., well, I just called up this guy in the middle of the night...HE gave me the legal citation on dimpled chads...aw shucks, your honor, just an honest mistake...yeah, That's the ticket!!!"

If nothing comes of this, whats to discourage lawyer in the future from just making up crap to support their arguments...why bother with the citations at all?

All you supposed ethical lawyers ought to be hopping mad when one of your own stoops so low, especially in a high profile case such as this. Hello...are you out there?

Considering that Boies is not a member of the Florida Bar, they can't do anything to him. Most state Bars are strictly good ol' boy networks and do very little internal policing.

As for the Non-TFL attorneys who are ethical, well, all ten of them are hopping mad.... :D

Gizmo: They can do two things to him. First, they could bar him from practicing in Florida again. No big deal, but embarassing. Secondly, they could refer the matter to the state bar Boies IS a member of, and THAT could be very damaging to Boies indeed, up to and including potential disbarment.

Consequences? Not likely. I won't say it's impossible to call him to account, but these days it seems that prominent democRATS are largely shielded from the consequences of their actions. Any further pursuit of the matter - no matter by who - will be denounced in the press as "vindictiveness" by the GOP.

Now come on, Clinton is up for disbarment in Arkansas because of his contempt of court ruling due to false testimony in the Paula Jones case (or Lewinsky? Can't keep 'em straight).

Shouldn't Boies face a similar fate? What he did was AT BEST negligent, and at worst, perjury (just like Clinton). I can't believe he's going to get off.

Of course, his client, Algore, would probably give him a bonus for being able to misrepresent his precedents like that.

Mr Boies not only lied to the SCOFLA and a couple of County Canvassing Boards, he refused to correct the error when made aware of it. That amounts to two ethical violations in Florida. Unfortunately, I wouldn't expect the Florida Bar to do anything. He has, however, come afoul of the New York Bar where he is a member. Those charges, as I understand, revolve around allegations that he and/or his firm paid for some testimony in a case. That is an extremely unethical and illegal practice and he is under investigation in that matter. Perhaps the New York Bar has some cajones, but I wouldn't bet on it.
