Suddenly, the most sacred text in America is under attack from all sides. The Constitution was never meant to be a "suicide pact," says eminent judge and author Richard Posner. It's "undemocratic," says University of Texas law professor Sanford Levinson. In this time of terror we need a new one — an "emergency Constitution" — says Yale Law School guru Bruce Ackerman. And Richard Labunski, in his fine and timely book about James Madison, pretty much destroys the myth that the Founding Fathers were motivated solely by noble impulses when they crafted the new government's guiding light.

Well, all I can say at the moment is my Bug-out-Bag and plan is all ready to go... Not to sound paranoid, because I'd be really happy if things were all happy-joy and peaceful. But there's way too much upset in too many different things to be comfortable, and I see things getting more messy every day. If I had to guess, I'd say it's just a matter of time before a lot of things really come unglued.

What worries me greatly is the latest trend of convincing people, especially young people, that the Constitution is outdated and needs to be brought into the 21st Century. They claim the 1st Amendment needs rewording because of the internet and terrorism, the 2nd Amendment needs rewording and/or deleting because we no longer "need a militia to protect us against foreign armies invading the country." Privacy, Search & Seizure and such protections need to be relaxed to protect us against terrorists. Etc. Etc. Etc.

Yeah right.

"IF we get rid of the right of free speech we can stop the next attack."

Hmmmmm, I don't see rewriting the laws as helping anything. What are they going to add or remove that would help anything?

These people are the type that believe that people actually follow laws when it is not in their best interests. If they got rid of my rights to do what I want to, I will likely do what I want/need to do anyway.

They can't jail everyone.

Quite honestly, I'm more concerned about the politicians, and maybe the police, in this country who would rape the constitution and take away all of our rights. I don't trust any of them (particularly the Bushies) farther than I can spit.

The constitution "democratic"?

No it's not, because the Constitution set up a Republic, not a Democracy. Our forefathers warned against this. The Democracy can be eroded by a majority of immigrants coming from socialist and fascist countries becoming teachers, and civic leaders, so the Constitution regulated the government from turning the Republic into what it is today, a socialist society, next a fascist regime, [ the detainee act] and then Communism. The last "plank" of the Communist manifesto [already started] is the disarming of the general population. You have to study both the Constitution and the Communist manifesto to compare the two see what's happening to us now.. To stop this, the general public has to stay armed, because the Government has sold out and they control the Guard. Best we not give up that right, eh?

Maybe so, but they've been there since at least 1949, or the 1860's depending on who you want to attribute the quote to.

When they start rounding up people like kanye west and cindy sheehan, I'll start to worry.... or be happy.... or be happily worried?

Right. The Constitution has had home-grown enemies for a long time. Let's just hope they're never in a position to actually, er, dump The Constitution.

Does the phrase "educated beyond their intelligence" mean anything to you guys?

At least Levinson, to his credit, calls for another Constitutional Convention, which presumably would use the amendment procedure called for by the sacred document itself (2/3rds congress, 3/4ths states).

These other jokers advocate just flat-out ignoring the Constitutions black letter and history in the "time of crises" - the time when adhering to it is THE most important, I might add.

Absurd. I'm ashamed to be in the same profession and these jerks today. Certainly, they are in the minority at least.

The guy is right about the Constitution not being a "Democratic" document for our system of government.

It is a contract for a "Representative Republic" system, and thank God for it.

If we were a Democracy, the majority of morons in this country would decide all matters. We would then have:

100 % tax rates
100 % welfare
0.0 % economic growth
100 % anarchy

One place my daughter ain't goin, is to U.T. They have more loonies at U.T. Law School, than they do at the actual State Hospital in Austin .

Actually Abraham Lincoln said that, Posner stole it.

So what are the People to do?

Take responsiblity and clean this nation up? Oh wait, hold on I need to catch the football game on TV, followed by 5 hours of CSI, CSI Miami, CSI NY, CSI SVU, CSI version 4.0, and then an hour of Survivor, hold on I'm getting ready... wait let's stick around a bit longer to watch this baseball game too. Hey, what was I supposed to be doing again? Ah nevermind, the news is on oh wow, terrorists on TV, we should hide now. Yay government throw away our rights to keep us safe in our cages!!

Sickening indeed, perhaps there is a great deal of national tension that will eventually explode? Second American Revolution coming our way? If it means setting things better than they were before, that'd be nice. Until people actually wake up and realize we're slowly becoming a prison nation, no one will lift a finger except to change the channel.

So a bunch of academicians propose something for discussion and we are all ready to man the barricades, huh?

"Fear became the ultimate tool of this government."

"And the truth is, there is something terribly wrong with this country, isn't there? Cruelty and injustice, intolerance and oppression. And where once you had the freedom to object, to think and speak as you saw fit, you now have censors and systems of surveillance coercing your conformity and soliciting your submission. How did this happen? Who's to blame? "

"What will the good people do, when the good people do nothing?"
