Concealed carry question

I live in Texas. I have my CHL. I know I must keep my firearm concealed unless I have to use it. When I carry my 1911 I usually carry a spare mag or two since it only holds 8 rds. Do I have to keep my spare mags concealed also? I called my CHL instructor and he wouldnt answer my question. He just hung up on me. This was not talked about in class, nor can I find it in the handbook.
 
just go ahead and open carry.

Your mags and anything else but the firearm itself can legally be out in the open. But it's best to keep it all concealed IMO.
 
Maybe its just me, but why would one carry concealed and carry his mags. exposed. Seems to me that would be like a sign HEY I GOT A GUN.

Defeats the purpose of concealed carry if you ask me.
 
No smart guy "hey I got a gun" is not the case. I only wanted to know if I had to conceal them just like my firearm. TX has a big problem with "picturing" which has always been a concern of mine.
 
we can open-carry here in NH if we want to, but i conceal everything under a jacket or loose shirt.

the only time i open carry is when i'm hunting, on my own land,or during July 4th weekend !
 
They should be concealed along with the gun.

Why in the world wouldn't the instructor answer the question, and why would he hang up on you? Did he say anything?
 
From the Texas state penal code, title 10, Sec. 46.035.:

(a) A license holder commits an offense if the license holder carries a handgun on or about the license holder's person under the authority of Subchapter H, Chapter 411, Government Code, and intentionally fails to conceal the handgun.

Unfortunately, although most other terms are defined within that code, "concealed" is not defined there.

I suspect you'll need to consult a lawyer familiar with Texas case law to discover how the courts there have defined the word.

Oh, and for myself? If I lived in a state that statutorily required a concealed handgun, I'd conceal everything related to the handgun too. But that's just me.

Exposing weapons related things seems needless to me. Why would one do so except by accident?

Here's a counterpoint. In TX, you can walk around with a long arm. You are also considered decent if you cover your lower orifices and equipment (let's not be crude).

A gentleman would put on a flesh colored thong and ride his bike around an upscale yuppy neighborhood (appearing stark naked) - leading to consternation and calls to the law but he was legal (he was also disturbed and killed himself later).

I assume that I could put on a flesh colored thong (horrors), sling my AR and walk down the street - legal - but why would I do such? To what purpose?

For those who went blind thinking of this image, I apologize. :D
 
Texas is one of six states that open carry is unlawful in, seems strange huh? The following site is a great place for Open Carry info.

I prefer Open Carry to concealed as a warning to BG's, rather than conceal which is a form of entrapment to me. The only real problem with OC is most people never ever see the gun. I OC daily and have never been stopped by a cop or had the cops called on me.
 
It'd be good to keep your spare mags secured. Not for any oc/cc factor, rather to keep the top bullet from being dislodged from proper seating in the mag. Should you need it, it does no good to jam a mag with a crooked round in the gun...could make for a jam.

An idea if you wear it out on the belt is get mag pouches that have a fold over snap. It would look like a knife/multitool pouch.

I'm having a little trouble understanding how or why the extra mags would be exposed. If this is a purely theoretical legal question then fine but I don't see how concealing the mags would be any kind of problem if your already concealing a gun. The easiest solution would be to get a good quality holster that has an integrated mag holder.
 
That makes for a slower reload, doesn't it.

If you have a legit cover garment, not a big deal to have another mag on the other side. Or carry a hicap gun (here we go again on extra mags).
 
I was recently on a business trip to Texas for several days. Since I have a non-resident Utah license in addition to my Indiana resident, I thought about bringing my carry gun. After reviewing all the carry restrictions in Texas, I decided not to bring it rather than take a chance of violating some detail of the law. Sorry, but I'm used to Indiana where you get a "License to Carry a Handgun". Concealed/Open, that's your choice. No restrictions as to what a food & beverage operation serves either. I love Texas and the Southwest for the weather and the people but your laws need some revision. Especially with your great history and tradition. I normally carry concealed everyday but at least I don't have to worry about legal action if my pistol shows or if it prints through the covering garment. Currently wearing a Woolrich Elite concealed carry vest (for our warmer months) very comfortable, covers my 1911 in a good holster and lots of pockets, some with elastic loops for mags. Highly recommended. Wear a leather vest w/ concealed carry interior pocket during the winter.

I wouldn't offer a legal opinion either, since I'm not a lawyer. I've read through Ohio's law many times, I'm planning to take a course taught by a local city prosecutor as well based on interpretation of the law. But still, offering an opinion on the law implies you have the knowledge base to qualify you to offer such a legal opinion. The instructor was covering his butt if he's not a lawyer specializing in gun law.
