conceal and carry laws in Ohio...

Sorry to get away from all of these great political discussions but I was wondering if anyone has any information about Ohio's conceal and carry licensing. Pardon my ignornace but I don't even know if we have licensure laws. I am interested in learning more though so any information will be helpful! Thanks!
 
Go to the Ohio Highway Patrol web site and go check out the state statutes. Should be around ORC 2923.12+. There is no State prohibition against *open* carry, just concealed carry. I have carried openly in Ohio, but there is no preemption law keeping large and liberal cities from passing their own bans, so check your state, county, and municipal law.

Loaded carry in a vehicle is illegal by statute. If you want it as close as possible for self defense use and still comply with state law, it has to be unloaded, in plain sight with action open. Two Ohio court cases say that you can have a loaded magazine on your person and the Ohio Atty General has produced a video instructing agencies that such is the current interpretation, however some departments still don't know about it.

Also, the Feely case (Hamilton County) may expand the rights of citizens a la Vermont...we'll see.

There is a web site that you should check out...I just wish I could remember it.

Do not take my word for it. You must read the law and talk to cops. It would be your chance to educate you, and them.

Like RickD says, concealed carry is against State Law. I would appreciate a link though to the cases cited about loaded magazines. I have been told numerous times by several LEO's that a loaded magazine or a speed loader is considered a loaded weapon. It's quite possible that they (the LEO's) just take the "everybody goes to jail and the prosecuter sorts it out" attitude.

I'd also like to know the court cases where having a loaded magazine on your person was found legal. If they were court cases, the courts could have found that the armed person was just being 'prudent.' This doesn't necessarily mean that it is legal for everyone. <grrr...> :mad:

I'd also like to see a copy of the videotape from the Ohio AG's office. How about a little help, Rick D?

I preparation for my visit to Ohio last November (from Arizona) I called 15 separate Highway Patrol Posts and a handful of PD and Sheriffs.

Most know about the court cases and the AG training video. I told the boys at ofcc about it at that time. I don't think they have done much of anything to find it. And I don't know that the AG or OHP would want to hand over a Double-Secret training video. The AG or OHP might fork over the court cites, but since you are just peons....well, good luck.

As far as using the NRA and packing.org for you research, I have found both wanting. I have sent numerous e-mails to both trying to fix incorrect interpretations of Arizona law. Nothing replaces going directly to the statues and talking to local PD, Sheriff and prosecutors on how the (correctly or incorrectly) interpret the law.
