He breaks it down as simple as it should be. Too bad common sense, isn't. This should be the open in every case where someone is sued for defending themself.

As the guy said, the facts were truncated. Thus, we do NOT know if the guy in the alley was "waving a gun around" or if he was simply loading his car to go to the range, or if he was a CCW permit holder or if he had just defended himself against a knife wielding assailant who had run off when confronted by the "victim" and his gun.

We also don't know if the cop was a plain clothes officer or not. Nor do we know if the cop just pulled his weapon and threw down on the "BG" without warning.

We don't know. Without more info, coherent commentary is impossible.
