Chinese fixed-mag SKS in California?

Greetings all,
One little quick legal check: I was planning to take a Norinco SKS, fixed mag, ten rounds, back down to California after the holidays. I know that they banned the detatchable-magazine SKS back a little bit ago, but am I correct in assuming that the SKS falls into the same category as the M1 Garand - not quite enough features to fall under the Roberti-Roos "assualt rifle" ban? I figure, no detatchable mag, no pistol grip, no flash suppressor, (maybe mine has a bayo lug, I'll have to check), so it should be good to go, right?

If it is okay, any good documents I should get a hold of copies of so that I can have the full, verifiable info printed out and in the riflecase in case someone mistakenly assumes they fell under the ban?

Thanks all, take care,

Not necessarily. The SKS for some reason occupies a very special, and equally bad, place in CA law. If I remember correctly, all of the recent manufacture "Sporter" versions of the SKS are illegal, but the Curio and Relic classified SKS's are perfectly legal.

You might contad CA DOJ, but they'll probably be of little help. You might even contact a CA lawyer that specializes in CA gun laws. I know of one, by the name of Bruce Colodny, that maintains offices in Orange [(714)639-6767] and San Bernardino [(909)862-3113]. There is also a web site associated with him by the url: www.gunlaw.com. It even looks like they use some of Oleg Volk's posters on their site.

As long as your Chinese SKS has a fixed ten-round mag and is not a "Paratrooper" (short-barrel) version, you are okay. I figure they will get around to adding these to the banned list during 2001 but, for now, they are pc.

I was checking one out at the gunshop today. You might have to remove the bayonet but like the others said, check with the DOJ first.

The Paratroopers (aka Cowboys Companion) versions are illegal in CA? I've seen quite a few for sale at gun shows, and don't see how barrel length would make any difference as it complies with the legal length.

Another SKS question....

CA SKS owners, since most SKSs I have seen locally are way overpriced ($170 for Romanian, $250 for unissued Romanian), what SKSs have you found on the internet that are cheap, good quality, and can be legally imported to CA ? Or better yet, who has a good source for SKSs in CA ?

I REALLY appreciate your help, thanks

I checked the NRAs summary of Roberti-Roos "assault" definition

And as best as I understand, for it to even be eligible to fall under the "assault" classification in the first place, it must be a

Semiautomatic centerfire rifle that accepts a detatchable magazine

So, it seems a fixed-mag SKS doesn't qualify as an assault weapon at all. Good to know how harmless the fixed-mag versions are, isn't it?

Any contradictions to what I seem to have dug up? It seems pretty clearcut, but I'd heard vague rumblings of dissent before. All pretty arcane laws really...
