CCW non-resident reciprocity

What I'm wondering is this getting around your home state by using another state's non-resident license (assuming you follow the laws of the state you're carrying in). Here's my example:

I live in Ohio, it isn't reciprical with West Virginia.
WV doesn't issue non-resident licenses.
Virginia issues non-resident licenses & is reciprical with WV.

Can I as an Ohio resident obtain a Virginia CCW and use it when I travel to West Virginia? It really stinks living 20 minutes from WV and not being able to carry there with an Ohio permit but Kentucky which is also just minutes away isn't an issue

Do you have an OHIO CCW?

Will WV issue you, a resident of Ohio a CCW IF you hold an OHIO CCW? Some states will, some won't. I know you say WV does not issue non-resident CCW's, but that rule may or may not be bendable, depending on your CCW in your state of residence.

When I lived in Oregon with a CCW, Washington state would issue me another CCW, but it showed my resident state on the CCW. Each state has different rules. And those rules CAN CHANGE from time to time.

Finally, IF you CAN get the WV CCW, as a resident of OHIO Virginia may or not recognize the WV CCW.

I suggest contacting the agency involved in issuing CCW's in each state. While what you ask IS CONFUSING (at least a little bit to me), you can work through it with each state. And don't be discouraged by 'No'. Just keep asking why or why not? Politely, of course. And trying to bend the rules almost will guarantee someone 'catches' you, making your life miserable for years to come. So, try to go the 'legal' route.

Worse case, CAN YOU MOVE to WV, as it's so close? Just curious.

Your proposed way of getting around a problem looks reasonable to me.

I'm not a lawyer (Mom was married to Dad) and I don't play one on TV.

But, when all is said and done, the Second Amendment is everybody's carry permit.

I have a pamplet called "Guide to The Interstate Transportation of Firearms" that was put out by the NRA. For WV it says "A licence to carry a firearm concealed, issued to a nonresident by another state, shall be honored if such state provides reciprocal privilege." The problem is, under OHIO, it says "caution...some units of local government, e.g., Brooklyn, Cincinnati, Cleveland, Columbus, and Dayton, forbid the possession of certain semi-automatic firearms and specified shotguns." It says nothing about reciprocal agreements with other states. Based on this, I am assuming I can't (legally) take mine to Ohio and you can't (legally) bring yours here.

For sure such great neighbors! I don't dare go with a relative to their doctor in Huntington....I won't go no where near the 20th street apartments w/o being able to pack! ;)

Biggest difference I can find between Ohio and WV CCW laws is this:

"You do not have to notify the officer, however, you must produce the License if asked by a Law Enforcement Officer."

In Ohio, you're required to notify them first thing as in most other states. Transportation laws are also a bit shadier in WV than OH imho. This being the "difference" between "Northern Ohio" thoughts, rules, and regulations versus West Virginia.

Sometimes I lived in Ironton, WV or Ironton, KY...not Ironton, OH :barf:
 
I'm still new to all of this, but my understanding is that the only reason you can't carry a concealed weapon into WV is because Ohio doesn't allow WV residents to carrry into Ohio. Our law simply requires that the other state recipricates the ccw right. To me this only seems fair. But perhaps I am not reading it right.
At any rate, when I thanked you for being a good neighbor, I was refering to the recent election. I don't know of any West Virginians that don't have family or dealings in Ohio and vice versa and we were thrilled to see both states go "red"...along with most of the rest of the country.
 
I'm going to have to fire off some emails and see which state is disagreeing with the other...I would just guess its Ohio not liking the WV laws perhaps? Very very few reciprocities exist for West Virginians. I only wish Kentucky had a non-resident license available, especially those that are in the counties bordering the Ohio River, it'd make it so that one could carry in all three states. Luckily Huntington isn't exactly "crime infested" compared to other places in the nation so Ohioians who cannot pack in WV legally (I know a few that pack anyways that have their OH license) can still travel there and feel somewhat safe.
 
The simple thing is to get a Kentucky permit. Its good in West Virginia and Kentucky and dozens of other reciprocal states.
Both states recognize out of state permits so long as the out of state state in question honors our permits.
The better thing to do would be to lobby your legislators in Ohio to honor WV and KY permits so that your permit will be honored when you come down and visit.
Now would be a good time to lobby for that change as the Brady Bunch suffered a tremendous blow in Ohio and are no longer under the delusion that the majority of the public agrees with them.
