California Supreme Court Decision Regarding Roberti-Roos Assault Weapons Control Act.

This bulletin has been suspended.


While the bulletin speaks to the effective date of the Kasler decision, it is now difficult to say exactly when the Kasler decision will become final. On July 19, 2000, the California Supreme Court issued an order stating "the time for granting or denying rehearing in the above-entitled case is hereby extended to and including September 27, 2000, or the date upon which rehearing is either granted or denied, whichever occurs first." This order means that the California Supreme Court could either rehear the case, which would postpone the finality of the case indefinitely, or the Court could deny rehearing, at which time the case would be final. When the California Supreme Court decision in Kasler becomes final, copycat/clone "series" weapons can no longer be manufactured within, imported into, offered for sale, or sold within California. A revised bulletin is forthcoming.

Thanks for the alert. I will pass the word on. But just to clarify,....this means that the inclusion of "post-ban' series rifles into the "pre-ban" Roberti-Roos, MUST-REGISTER umbrella,

that requirement has now been suspended to an indefinate date???? Or until the California Supreme court makes a decision on it???

Is this true???

If so, I wonder who the justices are that make up the California Supreme Court?? Who appointed them and what their political beliefs are.

I think once we determine that, you can predict what their "decision" will be.

So what are we supposed to do? Register under SB 23? Wait to see what happens?

I am going to call DOJ on Monday and ask where we are supposed to register. My suggest is all of us in Cali call and compare our answers from DOJ on here.

Before anyone replies with "Mrat why don't you ignore it and not register your guns" I tell you why I am going to register. I am an LEO and if I don't register and get caught, not only will I be charged criminally I will also be fired. I would be a perfect example to be held out for the media. I can see the headlines now: LEO refuses to register his "assault" weapons. Prison is an especially bad place for LEOs.
 
The vast majority of the judges on the CA SC are Liberal.... I bet you dollars to donuts that it will be upheld as constitutional.

You are probably right. At least citizens have been extended at least an additional 2 months (til 9/27?) to acquire ARs and AKs in California, albeit sans pistolgrips. Small consulation.
