Carry weapon in vehicle

Would it be legal for me to store a handgun, locked in it's own case, with the ammo in a different location, in the locked tool box on the back of my truck? I'm the People's Republic of Kalifornia. I ask because my roommates don't want guns in the house, but I want to buy one to take to the range.

Legal or not, is it a good idea?

Every once in a while, I need something like a folding shovel, Sven saw, chain, tarp, or whatever, and just as I start looking for it, I remember "Oh, yeah, it's in the pickup." The pickup disappeared one night just over a year ago and hasn't been heard from since. I'm glad that I didn't have any guns stored in it.

In your position, I would find different living arrangements.

The section of California law in question is Penal Code 12026.1:

12026.1. (a) Section 12025 shall not be construed to prohibit any
citizen of the United States over the age of 18 years who resides or
is temporarily within this state, and who is not within the excepted
classes prescribed by Section 12021 or 12021.1 of this code or
Section 8100 or 8103 of the Welfare and Institutions Code, from
transporting or carrying any pistol, revolver, or other firearm
capable of being concealed upon the person, provided that the
following applies to the firearm:
(1) The firearm is within a motor vehicle and it is locked in the
vehicle's trunk or in a locked container in the vehicle other than
the utility or glove compartment.
(2) The firearm is carried by the person directly to or from any
motor vehicle for any lawful purpose and, while carrying the firearm,
the firearm is contained within a locked container.
(b) The provisions of this section do not prohibit or limit the
otherwise lawful carrying or transportation of any pistol, revolver,
or other firearm capable of being concealed upon the person in
accordance with this chapter.
(c) As used in this section, "locked container" means a secure
container which is fully enclosed and locked by a padlock, key lock,
combination lock, or similar locking device.

You might also look for statutes relating to California's "safe storage" requirements, but your plan sounds like it would meet that criteria. I'm not a lawyer, so this isn't legal advice.
 
Sadly, I'm not moving out of California. Eventually though. It seems that according to the law, I'd be fine, so I'll go ahead and do it. First gun, here I come.
 
my first girlfriend would not let me have my gun in the house, so i kept it in my truck. with the fluctuating environment it did not take long to develope rust :mad:

please keep this in mind
 
Stop by your nearest scuba diving shop and get an appropriately-sized Pelican case that will fit either inside or around your locked case. They're airtight and watertight, and with the addition of a little silica gel packet, should keep your firearm rust-free even while sitting in your vehicle full time.
 
mvpel, are they temperature tight? the problem comes from the air temperature rising and the metal temperature not rising nearly as quickly. depending on the amount of moisture in the air, even in a sealed container, condensation will form on the firearm once the relative humidity and temperature of the metal hit that magic combination. i suppose you could vacuum seal it.
 
If you've got a silica gel pack in there to soak up excess humidity, I'd think you'd be okay. My gun safe is in my basement, and faces generally the same problem, and it never gets much colder in California than it does in my basement here in New Hampshire.

Also, the firearm would presumably packed in foam cutouts in the case, limiting the amount of air circulation around it.

There's always the alternative of telling the pantywaist roommate to grow the hell up and quit whining, I suppose, or presenting a counter-demand that he store all knives outside of the house.
 
dasmi, just one more reason for you to fondle and wipe down your weapon on a daily basis :)
it was only a problem for me because where i lived it got REALLY cold at night and when i would drive my truck (i had the rifle in the cab) the temperature in the cab rose and condensation would form on the metal. i didn't check it out for a couple weeks, and when i did it had some rust that i had to clean off. not a huge deal, just something to remember.

if it was me i would just not say anything to anyone and keep it in the house, which is what i ended up doing with aforementioned gf (before we split). your situation, YMMV, do what you have to do.
 
Carry a Weapon In a Veh?

Check out your state law and if you don't understand how it applies, talk to a lawyer.

I was once at a police firearms instructor seminar and their was a FATS machine in operation for those attending to use. There was one senario in which a vehicle stop is made and as the officer walks up to the vehicle, he observes a "riot gun" lying from the front seat with the barrel on the dash. The two officers from NY shot the woman immediately upon see the gun, in Texas carrying a loaded shotgun or rifle, even an AR-15 loaded in the passenger compartment is not a violation of law. The NY Officers could not understand the Officers from Western and Southern US who did not get too excited about the gun next to the driver. Just keep your hand off of it and don't do anything stupid.

Maybe I didn't make myself clear. I WILL NOT be carrying it on the seat next to me. It will be locked in it's case, then locked in my truck toolbox. It will not be accessible to me at all while driving. I live in Kalifornia, remember?

There is no law in NYS that requires a shotgun or long arm be locked in a case or trunk while in a motor vehicle. The law requires it to be unloaded. NY City may have such a law but it would be far fetched to assume it gives any justification for a shooting upon sight.

I think your addressing the wrong problem.

Your willing to put your firearms in harms way and at a risk of being stolen just because a girl friend, fiancee or wife (sorry your to late) dosen't like guns. I may outcast myself but are there any real men left in the world today.
Some times I wonder. Sorry I know many were thinking it but someone had to say it.
