The cops have now determined that the gun involved was a 45 cal Marlin, either lever action or semi-auto. They have gone to their database of rifle owners and are now in the process of knocking on the doors of all local owners of Marlin 45 cal rifles. You probably would assume they needed a search warrent or other evidence to link the owner to the crime. Sorry. If you live in Sonoma calif, (or anywhere else in Calif) expect to have your residence visited, and you will be asked to hand in your Marlin for testing.
In a police state like Calif, all of the laws that that used to apply, don't.
If you think that California sets the trend for laws passed in other states, then it is, indeed, a very sad day for our constitutional laws passed so many years ago.

You can't have it both ways. Either this is great, or it's a violation of your rights.


Bruce is one of two men from Bodega Bay who said two detectives showed up at their homes unannounced this week to inquire about guns the men own. They said the detectives asked if they could come inside to make sure the weapons were "safe and accounted for."

"No, officer, not without a warrant." Hmmm. Sounds simple enough.
 
Well, if using a government list is acceptable, if the suspect is identified as African/American, can they then ask for a DNA swab from every black man in a city, since the census lists race?


What they should have been doing was using the registry to pair down known suspects, not create a list of suspects.
 
I read about this on another board, and I really don't see what the problem is. The police would be ignoring their duty if they did not do the leg work to exhaust all leads. If they come by information that a certain person owns the kind of gun used in a crime, they would be remiss if they did not contact that individual and ask them if they could examine the gun.

If these gun owners don't want to cooperate, they don't have to.
 
And like I said, would they also be remiss if they didn't collect DNA from anyone who bears a single commonality to a rapist, like race?

It's the same thing. Using a single data point as a means of invading your privacy and demanding a search.

Yes they would be remiss if the single commonality boiled the list of persons of interest down to a reasonable number. The only test of reasonableness being: is it reasonable for us to do this with the time and manpower available. Further, there is no information that the authorities are demanding anything of anyone. It sounds like they are making requests. Perfectly within their authority and the law.

It happens more than you might think, without most car owners ever knowing. The police are looking for a certain color, approximate year, make and model. The Department of Licensing computers can do a search based on ranges of information and/or partial plates. If the search return generated is small enough, the police will attempt to interview the owners or look at the vehicles when they are in plain view or parked on public property.
 
Todays news still indicate that the cops are still fishing owners for the weapon. The weapon, a Marlin of 45 calibur, was described as a not common rifle. Let me guess. 45 calibur is very common. Recovery of bullet frags would indicate that their lead was of the rate of twist thru the barrel for a Marlin, lacking any cases. If the weight of the bullet fragments, and the rate of twist thru the barrel indicated that they couldn't be fired by anything other than a Marlin, then this is not a fishing trip. For an un-common rifle in an area like this, the search probably would have ended.
