Caliber limits on Blackpowder Cartridges

I didn't want to hijack the muzzleloader thread, so I'm asking in this one. :D

Just suppose someone had aspirations of oneday building their very own 4-bore. Does the .50 caliber limit apply to rifles designed to fire (custom) blackpowder cartridges? Would it have to be registered as a DD?

The boresize DDs are subject to "sporting purposes" - basically, you need to write a letter with a complete description of the cartridge and firearm (drawings, etc.) to the BATFE and ask them.

This is why shotguns over .410ga are legal - they're all over .50" but used for "sporting purposes".
