I am looking at several different handguns right now on GunBroker.com and others and would love to buy them all. Unfortunately for me I live in the great (otherwise) state of California. Please, hold your condolances.

I believe that the law states that you can only buy one handgun within any 30 day period. However, I was told by a gun shop owner that you can buy as many used guns as you like. Ok, so then does this rule apply to purchases out of state (ie, though online retailers), or is it one new gun a month. I'm not sure if this is the law everywhere, but I am really confused, if anyone out there knows much about it, please enlighten me. I could definitely use the help, and you guys seem to know way, way more than me :rolleyes: .

according to the DOJ:

"8. SALES, LOANS, AND OTHER TRANSFERS OF FIREARMS Handgun Purchases Limited to One Per 30-Days It is unlawful for a person to apply to purchase more than one handgun within any 30-day period. (Penal Code § 12072(a).) Exceptions The one-handgun-per-30-day limit does not apply to: • Any law enforcement agency or agency duly authorized to perform law enforcement duties. • Any state or local correctional facility. • Any private security company licensed to do business in California.

so looks like you are good to go.

If you purchase from out of state (i.e., online), then that firearm will have to be processed through an in-state FFL. That is your one-handgun-a-month.

If you purchase a used gun from an FFL in-state. That is also your one-handgun-a-month.

If, however, you purchase a used handgun from an FFL in-state that is also a "consignment" gun, then you are exempt from the one-gun-a-month law.

A consignment gun is where a private party commissions an FFL to sell his gun.

Remember, also, that with out-of-state purchases, you are not allowed to buy a firearm that has not been approved by the Kalifornia DOJ or that has been specifically outlawed.

And contrary to what the tin-foil-hat crowd thinks, the DOJ doesn't track your number, then tap your line, hack your computer, and send agents to watch your every move. The people to whom you'll talk on the above numbers think Kal's gun laws are just as ridiculous as we do.

But, if you buy PPT (Private Party Transfers), you can buy as many as you like, as long as both parties are in state residents. I really want a Keltec P3AT, but as long as the ROK doesn't have them on the list, I can't legally purchase it, or have it shipped in. However, if a friend of mine purchases it in Las Vegas, transfers it to another legal resident of Nevada who will be moving to CA, I can then buy the gun from him when he changes residence. He brings a legally owned firearm from another state and can then transfer that to another resident in the ROK. That's really the only way to LEGALLY circumvent the approved handgun quagmire, and, because it's PPT, you can buy as many as you like from your friend LOL.

Sorry but that is illegal also. It's a strawman purchase. If he fills out question #1 on the atf form with yes and has the intention of actually purchasing it for someone else it's a crime in all fifty states.
