Buying and selling guns

I am one of the millions who just started shooting since the last election.

Been having alot of fun at the range and think I will stick with it, its a nice past time and I like to learn about/shop for guns.

My question is can I get into trouble for buying x number of guns, or selling some in the future? Picked up 8 so far in the last six months, plan to get a few more and maybe sell some I'm not crazy about.

Should just ask my ffl dealer but its Sunday and I'm sitting here browsing the internet, figured it can't hurt to ask. Live in Alabama btw.

Unless AL has a law against buying over a certain number of guns within a specific period, you're ok. You might get noticed. SC has a law that, if you buy more than one handgun at a time from a single dealer, SLED will be notified. Usually, nothing comes of this except they know you bought more than one gun.

Be sure you buy and sell legally, according to the laws of your state and the federal government. A Google should turn those up for you.
 
as I recall, buying more than 5 at a time requires fed notification.

Also there are laws against making your living at buying and selling guns. The wording is something like your primary means of support or some such, but no limits like cars. Especially if you don't have registration in your state.

LOL! Thats true...actually a couple weeks ago I bought a star m-40 from a local shop and took it home and popped it into my night stand when she wasn't looking.

I don't think she would mind..but why take chances:eek:

Its funny...there are so many nice looking guns, and even some pretty decent inexpensive guns out there that its alot of fun to shop.

And they hold their value well enough I feel like if bought right and kept really clean I can have the fun of shooting and not lose any money if I decided to sell later on.
 
Ah see, you aren't looking far enough down the road.
Rather than figure how well it keeps it's value for trading on/trading up, consider how much you paid and the fact that if you bought quality, and you take care of it, it's a no brainer that your children will own it, and their own kids might shoot it as well.

Most decent firearms are VERY well built and with good care will last a very, very long time.

It's two or more handguns within 5 consecutive business days that must be reported.

27 CFR 478:
§ 478.126a Reporting multiple sales or
other disposition of pistols and revolvers.
Each licensee shall prepare a report of
multiple sales or other disposition whenever
the licensee sells or otherwise disposes
of, at one time or during any five
consecutive business days, two or more
pistols, or revolvers, or any combination of
pistols and revolvers totaling two or more,
to an unlicensed person: Provided, That a
report need not be made where pistols or
revolvers, or any combination thereof, are
returned to the same person from whom
they were received. The report shall be
prepared on Form 3310.4, Report of Multiple
Sale or Other Disposition of Pistols

shall forward two copies of Form 3310.4 to
the ATF office specified thereon and one
copy to the State police or to the local law

Sell

Personally, every gun that I have sold, I still regret to this day, even the cheap ones. I'm not selling anymore, I'll buy when I have the money and Layaway if I absolutely have to have something.

Our rule growing up was NEVER sell a gun. I can't remember that rule about do to neighbors, something, something... but I remember this one. The caveat was if you want to get rid of one, trade for another. I've sold one that I didn't think I had any attachment to and traded one for a gun that I love today.

I still regret both, the trade a little less. The sale was a bad idea - How many folks would like a Beretta 96D Centurion with night sights for $350 that was only carried as a back up weapon for a small town police officer??? Ooops!!!

I forgot, I actually did trade a Mossberg for a boat - that I'm OK with. I probably would have traded that gun for a half a pack of gum that has already been chewed by Janet Reno so that's a different story.

As far as Im concerned, this statement sums it up well.

If you sell to someone without going through an FFL holder, just make sure that a). the gun you are selling was acquired legally and b.) you create a document of sale (listing the weapon, date of sale, serial number, all pertinent info regarding the individual(s) involved with the sale, etc.) and have the buyer sign this document and provide a valid drivers license number and address (both of which should be written into the document and verified by you). If possible, bring a friend along so he/she can sign as a witness. Be sure to create an original and a copy, both to be signed/verified by yourself and the buyer (and the witness should one be present).

Of course, this advice is only applicable if you are legally able to sell to another individual without involving an FFL holder. Im not familiar with such laws regarding any state other than that which I live.

I to have bought many weapons over the past year (and sold at least one by the previously mentioned means), but am not at all concerned about being on some "list." Im more concerned about whether or not I will actually be able to continue buying certain weapons in the near future (in addition to finding ammo for them). ;)

Just remember, there is a difference between buying handguns and getting permits for them. Even in the communist state of NJ, where you have to buy from a store or a FFL dealer, you can still buy as many handguns as you desire as long as you hold them with your dealer until you can get legal permits. Just an important distinction that I felt worth mentioning.

Now there are some towns in NJ (rural), where when you fill out your permit application, the PD may not look closely when you write in that you want 12 handguns. I guess they are either letting you hang yourself by being stupid enough to ask for that many permits. Because as sure as God made little green apples in NJ you will be getting a visit from the powers that be if you ask for that many at one time.

BTW, being a member of this site I don't agree with that policy, but that's the way it is in NJ.
