Bringing an AR to Kali...

Ok... over summer I'm going back to Kalifornia. You think its possible that i could bring my AR out there and shoot it over summer or will the BATF and the rest of the Kalifornian democrats have a big fit? I would love to be able to shoot it over summer. Plus I dont want to leave it in a storage locker here in AZ cause it will fry... Thanks guys..

Okay - if you bring it in and you get caught on public land with an unpapered AR, say bye-bye to it.

However, the Cal-DOJ (not the BATF) doesn't have checkpoints on the highways specifically doing unregistered AW searches. Nor do they have the manpower to monitor all the BLM land on which shooting is done.

Furthermore, if you shoot on private land, there's not much they can do as far as search and seizures go.

Local LEO's don't even check unless you are caught committing a crime. Take it FWIW
 
Hey, I live in Arizona too. And if your looking for someone to hold it for you while you're gone, I'm sure we could work something out....

It is illegal.

Just realize you are taking a chance on bringing it into this state. You are breaking the law. Weigh the risks and consequences accordingly. I believe cars with out of state plates are usually more suseptable to being pulled over are they not? What are you going to do when the officer asks, "Do you have any weapons in the vehicle?" Is it worth it?
 
Hey, even though it is highly illegal..how about selling some AR-15s and AKs to Kalifornians?

Boy, we could make some money then! We would be just like the Kennedy family when they banned alcohol. My son may even become President! :D

Of course, other family members would become bumbling drunk idiots that get away with murder, but at least the citizens of my state would be just as dumb and support their reelection campaign. :rolleyes:
 
First off, I have to ask MDL if he's moving to Kali or just visiting?

Correct me if I'm wrong guys, but I believe that it is legal to transport firearms into Kalifornia (I think Sporting Arms are OK, but not sure) if you are here shooting a match or visiting. I was reviewing the laws recently and I remember reading something about it. I'll check again. But anyway, If you can prove residency in another state, you may be covered. It's registration where you're screwed.

Competitions, one exception. . .

IF you are stopped, and that is "IF", you must provide proof in the form of a formal invitation to the competition shoot. Most LEOs will honor that. If hard pressed, you can provide some sort of receipt from the shoot stating that you paid the fee to attend.
 
MDL, I knew I'd find it. It's under the 2001 Dangerous Weapons Control Law, Article 2. It reads as follows:

ARTICLE 2. UNLAWFUL ACTIVITIES

12280. (a)(1) Any person who, within this state, manufactures or causes to be manufactured, distributes, transports, or imports into the state, keeps for sale, or offers or exposes for sale, or who gives or lends any assault weapon, except as provided by this chapter, is guilty of a felony, and upon conviction shall be punished by imprisonment in the state prison for four, six, or eight years.

One of the exceptions is a follows:

(p) Subdivisions (a) and (b) shall not apply to the possession and importation of an assault weapon into this state by a nonresident if all of the following conditions are met:
(1) The person is attending or going directly to or coming directly from an organized competitive match or league competition that involves the use of an assault weapon.
(2) The competition or match is conducted on the premises of one of the following:
(i) A target range that holds a regulatory or business license for the purpose of practicing shooting at that target range.
(ii) A target range of a public or private club or organization that is organized for the purpose of practicing shooting at targets.
(3) The match or competition is sponsored by, conducted under the auspices of, or approved by, a law enforcement
agency or a nationally or state recognized entity that fosters proficiency in, or promotes education about, firearms.
(4) The assault weapon is transported in accordance with Section 12026.1 or 12026.2.
(5) The person is 18 years of age or over and is not in a class of persons prohibited from possessing firearms by virtue of Section 12021 or 12021.1 of this code or Section 8100 or 8103 of the Welfare and Institutions Code.

Now, I'm no lawyer, so your best bet would be to contact the Kali DOJ for clarification!

Well... I do have my arizona ID which has a physical address on it. But I attend college here. But I would just be visiting cali for the summer and returning in august. I called the DOJ and not to my surprise...they didnt answer anything. I got some old bat on the phone and she said that I couldnt have any type of assault weapon at all. Ill call back but I wouldnt know what to say except that I would be practicing for a local competition at a firing range... But I dont know if they have Bushy AR competitions...But Ill give em a call. If anyone has any other info or ideas...let me know. Thanks for all the input guys... I appreciate it a lot.

Bring it. The only way to show the futility of the laws here is if people are willing to practice civil disobedience. My guess is that you wouldn't even have the chance to practice any civil disobedience however. I have yet to hear of someone being badgered about whether their firearm is registered. The only reason they would get in trouble is if they were breaking some other laws and being seriously investigated.

The first time I took out my SKS here in CA, a swat team was practicing with their AR's next to me at the range. One of them came over and asked me what kind of rifle I had, when I told him it was an SKS, he said he'd just arrested a "gangbanger" who had the exact same kind of gun that turned out to be illegal to own in CA. He then asked if he could check it out, I let him run a few rounds through it and he kindly handed it back to me. The majority of LEO's don't care about what kind of weapon you have so long as it is not stolen. I don't think they have the ability to run an instant check to see if your weapon is registered. They wouldn't waste their time finding out if it was anyways.
 
MDLewis, This is the ONE! person who I talked to at the DOJ firearms department who seemed to know what the H*** he was talking about! His name is Dennis and I must have talked with him for about an hour back before all the registration stuff went through, I mainly called to talk about the goofy stuff that was going on when the AK47 and AR15 series weapons were added to the 1989 R/R assault weapons ban and were no longer covered under the recent SB23 assault weapons ban.

Dennis was even nice enough to return my call when I left a message saying I would like to talk with him, he's been there for about 15 years if I remember correct and he didn't sound like he was too agreeable with all these regulations seeming how they have to keep track of the stupid things. Sacramento area code (619)263-4885 That SHOULD be the number for his own private answering service when he's not in. If he's not in or the number is not correct anymore, call back to the DOJ firearms devision and see if you can get somebody to put you in touch with Dennis. I wouldn't mention where you got the number, telling him that you got his number off the internet might cause him some discern knowing the nature of the internet and the agency of government he works for.


NO BATF/DOJ BASHING FOR THIS GUY! He was nothing but helpful and kind to me. The old biddy women that work there, hell if they can't even give out information that is partially correct. I've got friends who called in and they could tell that the women were reading the information right off of the web page word for word, they were totally clueless.
 
Frankly, I personally can't imagine taking an AR into CA. I don't even like visiting over there any more. But, I have the simple option of not going, and spending more time in relatively free AZ.

Here's the problem as I see it ... even if you could figure out a way to do this legally, what are the odds you'd be treated fairly in that fascist gulag? You're a young, out of state guy, right? You are very expendable to them. Very expendable. The wrong LEO's there would have few worries about hassling you. They could confiscate your very nice rifle, they know you'll be glad to leave without jail time, and you're not likely to have the time or means to fight them in court.

If you do decide to call someone in government about these rules, at least do it from a pay phone. Everyone has caller ID now, and why make it easy on them. Odds are, that's a paranoid concern ... but it is pretty cheap paranoia to satisfy ... ;) [You're not paranoid if they're really after you ... ;) ]

Kalifornia is one of those places that I don't even want to "think about visiting" unless it's to see the M.O.U.S.E.

Ha, and my sister lives (is a prisoner) there too.
