Fla. Tourists Warned on Deadly Force Law

MIAMI (AP) — Clark Ramm sees shades of the Wild West in Florida's new law giving greater legal protections to people who shoot or use other deadly force when threatened or attacked.

"It seems like everybody ought to be packing a piece," said Ramm, a visitor from Ukiah, Calif., who found out about the law Monday from a gun control group handing out leaflets at Miami International Airport. "I don't know if that's the right thing to do."

The leaflets begin with the words "An Important Notice to Florida Visitors" in bold red type by the Brady Campaign to Prevent Gun Violence.

"Do not argue unnecessarily with local people," it says. "If someone appears to be angry with you, maintain to the best of your ability a positive attitude, and do not shout or make threatening gestures."

Florida's "stand your ground" law, which took effect Saturday, means that people no longer must attempt to retreat or defuse a threatening situation before using violence in order to later claim they were acting in self-defense. People already had that right in their homes, but the law now allows them to meet "force with force" in any place they have a legal right to be.

The right to "stand your ground" does not apply if the person is confronted by a law enforcement officer.

Proponents of the measure, pushed by the National Rifle Association, say it will make Florida a safer place, not more dangerous. Gov. Jeb Bush has repeatedly pointed to a 34-year low in state crime statistics to demonstrate that Florida is not a haven for violence.

"It's pure, unadulterated politics," Bush said last week of the Brady Campaign's tactics. "Shame on them."

The Florida tourism industry, however, is taking the campaign seriously, with Visit Florida — the state's official tourism marketing arm — issuing a statement calling Florida "a very safe and secure destination that excels in caring for its visitors."

"We believe that Americans and international visitors are smart enough to understand that the Brady Campaign is one group's political agenda and not a real safety issue," the statement said.

Florida hosts more than 1 million visitors on any given day, with nearly 80 million tourists visiting the state in 2004, according to Visit Florida.

The Brady Campaign leaflets, which the group intends to hand out for about a month at the Miami and Orlando airports, call the measure the "Shoot First" law and urge people to "take sensible precautions" while visiting the state.

"There is no other state in the nation — and no other civilized nation on Earth — that has a law like this," said Brady Campaign spokesman Peter Hamm. "It could cause the most aggressive people in society to overreact."

The group also has taken out ads in major Detroit, Chicago, Boston and London newspapers about the new Florida law.

Several people who got the leaflets at the Miami airport on Monday appeared taken aback by the new law.

"It's a little scary," said Melissa Vosberg, on her way home to the Chicago area after a cruise in the Bahamas. "It's 'shoot first, ask about it later.'"

They already have people believing its a bad thing. Wonder if this will really create problems with floridas commerce? Its frightening to think so many people believe this brady crap....

The Florida Atty General needs to get an injunction against the brady bunch over this.

The leaflets are political campaigning masquerading under the nom de plum of a "safety advisory". That's fraud.

It's also commercial speech that can be regulated based upon the "scare tactic" involved if it is an attempt to cause general panic in the populace.

A simple enforcement of a law against pan handling and leafletting in airports should rectify the problem. A TV advertising plan by the tourism council about how they are attempting to stop or scare away the tourism industry would also be effective in reversing the public's opinion of such tactics.

It not only won't affect tourism, it will probably increase home sales. My wife and I were looking to relocate to the south, Florida just became that much more attractive! :D

Seriously, I doubt people heading to Disney or Key West will even consider this law, much less care about it. I think they could do almost anything and not have it affect tourism.

the brady campaign should be telling the above to people in all 50 states.

The way I remember it, Florida had a problem with violent crime, and that was not good for them or their "tourist industry" .... so they enacted concealed carry laws ... and although the Brady Bunch insisted that the sky would fall, that everyone would be shooting each other down in the streets, what actually happened was things got safer. In fact, it worked so good that a lot of other States tried CCW, and it worked for them too.

Now Florida is passing a "stand your ground" law, and the Brady Bunch insists that the sky will fall, that everyone will be shooting each other down in the streets ... it sounds to me like the Brady Bunch is actually a parrot ... maybe we should send them some crackers. Sarah wanna cracker?

Consider the source.

Isn't it documented that CCW holders as a group are among the least likely to lose control and shoot someone without justification? Again, consider the source.

like no other state in the Nation?

I think that, in general (CCW terms) it's like about 35 states in the Nation, and likely to be more before it is less....

I was once naive........

I once asked WHY????........

why???....

why do it?

But now I can see why we have such a rich history of political assassinations.

(IS NOT ADVOCATING ILLEGAL ACTION)

Where on earth do these idiots get these ideas?! "Shoot first, ask about it later"? What about the fact that people will still be held -- as they always have -- to legally recognized standards regarding whether use of force was justified?

These goddamned liars just keep spewing stuff about how, "It'll be legal to shoot someone you had an argument with over a parking spot." Utter bullcrap, and they have to know it.

And yeah, regarding Florida being the "only state in the nation" with such a law is a bold-faced FALSEHOOD. I read months ago that this brings Florida into line with LOTS of other states that already have such laws.

Of course, Brady morons would never avow that this is true, because people would start asking, "Well, has it been a problem there?" and of course the answer is NO.

Someone needs to shut these loser idiots up by pumping the truth about this law out at high volume.

FL is not special in this regard. PA has the same law, you can shoot if you "reasonably believe" you life or the life of another to be in serious danger. Brady makes it seem like FL is the only state that is like that. It does not change the fact that you can only shoot in self defense if you life or anothers is in serious danger!

Hopefully, they will have to issue 'safety bulletins' about travel in MI soon.

Not that they shouldn't now for travel to Detroit.

All we need to do, it would seem, is counter their hysterical alarmist ads with an ad of our own that LISTS THE OTHER STATES THAT HAVE HAD THE SAME KIND OF LAW FOR YEARS WITHOUT PROBLEMS.

As with any other argument between the pro-gun and anti-gun sides, when facts are shown, antis HAVE TO LOSE. There simply is no fact to their views.

What are the other states that have had this law for some time? I know PA is one. We should send an email to the Brady bunch with this list and saying how none of these other states have had a problem. I would be interested to hear the reply they gave.

I suspect they might do something to further jam their foot into their mouth:

maybe say something like, "Well, the other states don't have the black and hispanic population that Florida does..."

Honestly I would be more than happy to have a fewer amount of tourists here. I mean have you tried driving in downtown Orlando at 5 in the afternoon?

Seriously though, the brady folks around here havent been met with that much support.(the only ones that are usually shocked are the british tourist- yeah we have A LOT of them, and we all know the gun laws there)
I had one brady follower hand me a flyer when i was stopped at a red-light on the way to wally world (yeah great place to hand out anti-gun flyers  )
I politely handed her back the flyer saying I was a gun-owner and supported the bill. She called me a "paranoid militant"
I told her to be patient waiting for the police when if she was ever to be raped.
.........The look on her face was priceless. :D

Keep the leaflets next time, ask for extras for your friends. It costs them money and you can draw targets on them.
