Is Beretta also being sued?

If yes, does this mean if Beretta
does not comply, like S&W, will the government find a new service pistol?

Beretta is mentioned in some of the suits.
I was at Beretta a few months back. They didn't have a current contract for military arms (no idea if there are any impending contracts).
The important thing now is to ensure the Feds (Clinton, that is) don't use coercive tactics, such as witholding appropriated funds, to force the states into complying with the extortion.
 
It's not economically feasable to find a new service pistol. Even if there isn't a current contract there are tens of thousands of pistols already in service. They are going to dump what they alreday have. Too much money in the guns themselves, spare parts and mags. Not to mention the costs and problems involved in having to retrain all the troops and teh armorers on a new weapons system.

Even if Beretta gets on the gov't's "no-good-nick" list the M-9 isn't going anywhere any time soon. Look at the 1911. The last one's the gov't bought were in W II but they were used up into the 1990's. Just because teh Fed's might not be buying doesn't mean they won't use what they have.
 
Child-proof locks and 'smart' gun technology is irrelevant in a military sidearm. The three biggest factors ina procurement are reliability, maintainability, and price. Locks and stupid gimmicks add cost while hindering the R&M and usability of a military side arm where the need to share weapons in battle is very real, not to mention the logistical nightmare involved in matching guns and authorized users in the armoury everytime weapons are issued. It's stupid enough in the civilian world, downright unworkable for the military. Then there's the issue of Fed Acquisiton Regs (FARs), where such sweetheart deals have no merit or standing and would get you protested out of the competition. This whole S&W thing is going to turn into a big abortion, what the gov. did was illegal, unethical and immoral, whauddaya expect from Slick Willie? M2
 
Don't forget the SIG M11s, the HK 45s, and all the other stuff they still use.

The govt has bought over 400,000 M9s. Why? Cuzz that's how many they think they need. At normal usage rates, each has a service life of 40 years. Will be around for some time unless the govt decides they want to spend a lot of money to replace them. Figure about $40 million at $100 each for a good polymer gun at volume.

OTOH, that's "only" about the price of one fighter aircraft.

I would not expect the Secret Service to dump their SIGs, the FBI their Glocks, The INS/BP their Berettas, SIGs, and HKs, the DEA their SIGs, Glocks, and HKs anytime soon either...

Then again, the Ohio State Police dumped their Beretta 40s for SIG 40s pretty quick...

This is politics after all. Stranger things have happened?

I think we might be off base with this one. Slick has already asked the law enforcement community to support S&W with future purchases. With a simple (and in my opinion an unconstitutional executive order), he could decree the replacement overnight. They are his showpiece. Does anyone think he will let them go down the tube in the face of a boycott? I really wonder.
 
Good point AK9, lets give this a try! Boycott Smith & Wesson.....nada not single trade.......Then the smarter and tougher gun companies will be stronger and slicked up his phillies will be back tracking for cover and get heat from LEO who should be speaking loud and clear about the benifits of an armed populace as should every General in this mans army! We could use thier voices in this matter. I say let S & W (who shot themselves in the foot) drop of the face of the earth. Maybe Slicked up his phillies will buy Smith & Wesson for the good of the countries law enforcement and then he and others of his socialist ilk will come off their drugs and we can welcome them back to America.
