Beretta Magazines

While goofin' off at the gunsmith today, we took a magazine for my Beretta 96F, and compared it to a 9mm surplus high capacity magazine and found them identical in every way except the mouth of the 9mm was just a hair more narrow. We took a pair of pliers, and opened it up some, and found that the 9mm magazines work just as good as the .40 S&W mags. Never jammed, and as a bonus they held 11 rounds instead of the usual 10. I bought two of them, and will probably buy more IF> It isn't illegal to use these magazines (Pre ban, military surplus) in a handgun niether marked in the same caliber, nor gun. I figured that since I'm not manufacturing anything, only doing a 1 or 2 millimeter "adjustment", that I'm still within my leagal 'rights'. Can anybody comment on this? The magazines are cheaper anyway, and they hold an extra round. To me, this is a win-win situation. Any input is appreciated.
 
So it sounds like you have a Pre ban 9mm magazine. whatever you put in it should be legal. Hmm... If you got a post ban Beretta .40 magazine and loaded it with 15 rounds of 9mm, is that legal? The magazine is just loaded incorrectly.
How much were the magazines?
 
They were 30 dollars. I usually pay 35 plus for the factory mags new. The 9mm mags are used surplus, but are in excellent shape, and so I don't mind spending the money. CDNN used to have .40 mags for 13.00, and I bought a bunch of them too. I still like the 9mm mags better. That extra round makes me feel like I'm doin' somthing the government doesn't want me to. I also have a pre-ban 5 gallon, one flush toilet too! My hot water heater is the older type that heats water hotter than 120 degrees. I'm just a seething hotbed of civil disobedience huh?
 
In my opinion it is not worth the extra round if I am in some way stressing the metal around the feed lips by bending them and over time they crack from use.....
