Benelli M4 12ga shotgun legal in CA?

I've been getting conflicting answers on this. Can i legally buy a Benelli M4 with the pistol grip in California? One person told me it was ok as long as it doesn't hold more than 8 shots and doesn't have a folding stock or detatchable mags.

The other said any pistol grip on a shotgun in CA is illegal.

Whoever told you that needs to get them selves educated. My Remmy 870 has a pistolgrip stock, bought it that way, perfectly legal. 'Course, that's a pump gun. Semiauto shotguns are restricted just the same as rifles in CA, except that the legal maximum mag capacity is 5 shells IIRC. The M4 *might* be legal, if you're talking about the same one I'm thinking of, fixed stock (the fake collapsable one that looks like the military one,) pistol grip, tube blocked at 4 shots.
 
From the California AG web site:

12276.1 (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
. . .
(6) A semiautomatic shotgun that has both of the following:
(A) A folding or telescoping stock.
(B) A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.

(7) A semiautomatic shotgun that has the ability to accept a detachable magazine.

(8) Any shotgun with a revolving cylinder.
