"On 10/25/2000, the bureau of Alcohol, Tabacco and Firearms sent approx. 30 federal and local agents in stormtrooper attire to confiscate firearms from a dealer who, according to what they told him, "did not have his papers in order." Jerry's Guns and Ammo d.b.a. Specialty Firearms of Mesa, Az., was the latest in a long lost of gun dealers who've been paid a visit by people who, when rightly told, "You are not supposed to do that" respond by saying things like:"We're the BATF. We can do whatever we want.""

They took many of his classic, mint condition guns and threw them all together into a trash can where they were scratched, gouged and ruined. He was told he did not have a $100 "pawn permit" and took 274 of his guns. They also took the video surveillance tape (which was not listed on the warrant). They confiscated over 3,000 records that show private information of 3,000 Americans by taking his sales records for the past 15 years. They came back on 11/10 and accused him of manufacturing ammunition for resale without a license. (Jerry only sells reloads he purchases in quantities from licensed ammunition manufactureres but they confiscated 30,000-plus rounds, kegs of powder, cases of bullets in various calibers, primers, shell casings etc..) They succeeded in running him out of business and stripping him of his retirement.

He has not even been charged with anything, nor has any justification been given as to why such an offensive operation been commited against a man who has complied with all the laws.

Jerry Michel states: "If these guys will do this to me over some $100 permit when I was already licensed to sell firearms, I shudder to think of what they would do to someone over a $10,000 violation."

Yep, they still have not charged him, won't show why on Earth he would need a pawn permit when he doesn't pawn, won't say who supposedly did the "straw purchase" they are accusing him of doing, and won't give his guns back so he can earn a living.

The BATF are scum. Mesa PD wears BATF kneepads.

BASTARDS!!!! Obviously due process and the rest of the Bill of Rights mean nothing to these people. This agency is dangerous and completely out of control. What we need is a mole to tip us off the next time these thugs stage a raid like this. Then we can give them a proper welcome.
 
ATF are notorious for this. I did not like these guys when I was a cop and even less now. They are elitist, and sadly, are, commonly, IN NO WAY, the hunters or gun-appreciating individuals that TFL readers are.

I say lawsuit. I wish I was a lawyer, dammit. Gestapo police tactics would keep me busy, rich, and satisfied attorney!
 
We could defang the BATF by repealing the RICO statutes which they, and other Federal and local agencies love to abuse. Asset forfeiture allows them to confiscate property and still keep it even if the person is never charged (its civil, not criminal forfeiture), and even if the person is acquitted.

Cant we do the same with them??? I mean the government is "For the People By The People" (HAHAHA), I think we (through the courts of course) should seize, some of those really nice Suburban's they drive around in. Oh yeah and some ATF agent's houses. The real nice ones paid for by the spilt blood on the US Citizens (read slaves) that is on their hands... hmmmmm :rolleyes:

One attack is an attempt by a police officer (ex-police officer?)to justify ATF behavior by saying they had probable cause to make the raid. This justification includes a copy of the affidavit for the search warrant.

It looks as though the ATF didn't think they had enough on Mr. Michel with the gun-pawning violation so they sent in pairs of undercover officers to confuse and trap him into straw purchase violations. This is a perfect illustration of their mentality. They could have chosen to send a single agent to talk to Mr. Michel about the pawn violations ( that would be too reasonable, after all) but instead sent teams of agents in to solicit more violations in order to to gain a pre-text, however flimsy, to launch their search-and-destroy mission.

We need to spread the word about this abuse of power far and wide. I can't wait to see what the government comes up with at the hearing (assuming there will even be one).

I have heard of this case before, it was discussed on this forum at some length. I have no doubt that it is bad.
I would suggest at this point that we use this atrociuos raid on an honest citizen as a cause celebre in favor of proceeding with the dismantlement of the BATF as an agency of the Federal Government.
This new administration owes people like us some big favors and I doubt if anyone who voted for George W. Bush or who is going to vote for him in 2004 will shed even one tear at the demise of the BATF.
The best way to solve the problem of this rogue agency is to get rid of it now while we have the possibility.
We should not have to fight our own government paid with our own taxes in the courts when we have an administration that is supposed to be sympathetic to our cause.
 
Country management changed a few days ago. I suggest someone (undefined) get facts to new management. Is the NRA aware of this event? How 'bout AZ legislative delegation?

Point is, b*tching about the event in the forum makes us feel better but does nothing to solve the problem.

BATF needs to have a few teeth pulled and perhaps the AZ event is the means!
