background checks

I was wondering just what it was they check for, as I have been convicted of a Felony for possesion of marijuana in 1995 in Arizona, it was reduced to a misdemeanor. Do you think I will have a problem qualifing for a handgun?

Lake, I would say, offhand, that you have roughly the same chance of getting a Proceed as I have of campaigning for Hillary. :(

Example: my best friend owned a pistol that he bought privately. Last December, he found himself in a tight spot and needed cash, so he pawned it. When he went back to pick it up, he was denied. Reason: he was cited for "domestic violence" a few years ago. He threw his crackhead (literally) girlfriend against a wall when she came after him with a knife. She went to the hospital, then jail. He went to the magistrate and plea-bargained for a misdemeanor DV, instead of felony assault. He got it, no jail time, no probation, just a HUGE fine... and he can no longer legally own a gun. For the rest of his life.

I've also seen people get denied CHLs for misdemeanor possession convictions from 20 years ago.

Sorry for the bad news. Good news is, you do have other options. :(

4v50Gary, the expansion of the background check has clouded the issue. I don't know if misdemeanors discount you. I know that "certain misdemeanors" will. It was Klinton that pushed the addition of DV and a bunch of other items to the prohibited list for the not-so-intant check.

If I was your buddy and there was any doubt, just pop into a gunshop and ask to have the background check done. If he is refused, he should get a lawyer and sue to have ALL HIS CIVIL RIGHTS re-instated. I know a guy who had afelony assualt on his record. Did the petition and got his rights back. He now owns guns. He does have to take a copy of the court finding with him, but it gets the job done.

Well I just got off the phone with the court records dept. and they said I have to send in a packet with my finger prints to recieve my record. So I can see just how it looks when they go to look it up. As long as it show up as a misdemeanor and not a felony, I should have no problems purchasing a handgun.

Lake, check your State laws. Some states allow you to ask the Court to expunge some criminal records after a certain period of time. A good lawyer can probably give you more specific information.
