ATF form 4473

As some of you may know, a week or so ago I purchased a new Taurus Total Titanium 38 special from my local dealer (www.hotshotsga.com) here in Georgia. Well, currently Taurus has this ad going on where you can recieve a free NRA membership if a Taurus gun is purchased.
According to Taurus, the buyer must send in a copy of the store reciept and the background check form called ATF 4473. Well, according to my dealer, iyt is against the law for the dealer to make copies of this form and send it anywhere.
So, I am stuck between a rock and a hardplace as far as my free NRA membership goes. Is it, ort isn't it legal for that ATF form 4473 to be copied and sent to Taurus?

You know, I never managed to get an answer to a similar question.. so I broke down and spent the $35 to cover the cost of a new membership for the individual that was gonna get the free one anyway.

Sorry I'm not of any help.. but I didn't come up with much either. :(

I don't have a definitive answer, but I wouldn't think Taurus would ask their dealers to do an illegal act in order to give away the memberships. That and the fact that the promo has been very successful, tell me Taurus is right and the dealer is wrong. I also see that Taurus states in bold letters that they will destroy all 4473's once the coupon has been sent. Somehow, I trust them more than I do BATF to keep their word.
 
As a former FFL holder, I believe it isn't against any law that I know of for the dealer to give a copy to the individual that signed the form. In fact I would think you are intitled to a copy of ANY form that you must sign.
 
Just tell the dealer you want a copy of what you signed ... the 4473. I've usually been given a copy without asking, and I've always gotten a copy when I have asked.

As diyj98 noted, you are always entitled to a copy of what you sign. And, as a matter of wise personal management, you should always get a copy of what you sign. That protects you, in case someone would later alter such a document .... and, I've had that happen to me.

Don't know the strictly legal answer, but remember reading in a recent NRA 1st Freedom magazine that the S&W $50 summer rebate sale also required the dealer to forward a copy of the same form to S&W, so I doubt that it's illegal. However, I think in the case of S&W, one would have to be a fool to 'take advantage" of the rebate.
 
Another thing on the 4473. CROSS OUT the BACK PAGE. Sorry for yelling, but I really wanted to get your attention!

Yeah, guess what: in case you want to buy 3 or 4 guns in the same transaction, the back page has room to list selling you at least 3 more guns in the same transaction. (IIRC)

I bought a rifle from one Reno shop, and BATF called to verify I had actually bought it and the Mac 11 that the ( not printable, but the gist if it is very easily imaginable ) dealer had listed on the 4473's back.

I informed the BATF I'd never even *looked* at a Mac 11. Whether or not the local BATF believed me, I think they did believe I was ready, even anxious, to committ mayhem to the dealer ( for starters ).

Fortunately for my freedom, however, another miscreant had recently built a mail bomb sent to a Nevada State Trooper. The dealer was such a dear that he mailed it for the guy. Now the federal government is providing them both with room and board.

It may be against the law for the dealer to copy and SEND the form to someone else (to protect your privacy), but unless it's a specific Georgia State Law, it's not illegal for the dealer to give YOU a copy of form 4473.

I made two purchases this month, and both times the dealers gave me a copy of the form without even asking.

If the dealer refuses your request, ask him to show you the BATF regulation that prohibits him from giving you a copy.
 
Nope it sin't illegal and I believe it even states that on the form. If I remember correctly it says that you are "entitled" to a copy if you request one. That is stupid for them to say i'st illegal for you to have a copy of something that has your personal information and the information on your firearm. Ask him to show you the regs that state that he can't give you a copy of something with your personal information on it.
 
Mossberg has a deal where if you fill out the survey enclosed with a new gun, they hold a drawing and refund the purchase price to you. But you must send them the receipt and a copy of the 4473. this is just another case of a misinformed dealer, nothing new :(
 
I was given a copy when I bought my Para-Ordnance P14-45 so I could send it to the factory with my coupon for two high capacity magazines. I'm in PRNYS so I don't think the gun shops up here are going to do anything illegal.

In my town there are two gun dealers. One gives me a copy of the form automatically with every gun I buy from him, the other doesn't.

How's that for help?

I ran into the same problem with a dealer. His copy machine was down for repairs. He just gave me a blank form that I filled in the front again and sent in a copy of that.
