Anti's in Indiana at it again

The session has just started, and already a search of introduced bills reveals a plethora of new restrictions and infringements on the plate. Here are just a few of the bills in question:

SB282--one gun a month, safe storage (lock up your safety), and more.

HB1034--prohibit sale, transfer, etc. of firearms and ammo on county property.

HB1296--raises minimum age of CCW permit issuance from 18 to 21.

HB1297--currently, there is no training requirement for CCW permit issuance in Indiana; this bill would change that.

HB1298--relating to, among other things, transfer of ammunition; from bill summary: "Requires the transferor of the handgun ammunition to forward certain information about the transfer to the superintendent of the state police department."

HB1299--requires safety info to be given to CCW permit applicants, probably not a bad thing, as long as it doesn't lead to more requirements in the future of one type or another in the future.

There are more, including a couple that turn certain user actions of firearms from misdemeanors into felonies, but I didn't have time to list them all.

The only positive bills I saw was a pair of bills that would prohibit frivolous lawsuits against the firearms industry (SB72/HB1043).

Indiana residents: is this a common occurrence, to have so many anti bills introduced each session? I seem to remember a lot last year, with most if not all of them dying. Indiana law regarding firearms is still fairly decent, so I'm thinking that these waves of anti bills are more symbolic whining on the part of the liberals in your House and Senate than anything else. Still, I regard them as a threat.

Still, you residents would know better than I: are these bills anything to worry about or not?

You can bet they would require "Name, Address, ect" of anyone who buys "handgun" ammo. It is just another "backdoor" registration scheme. That would violate the Firearms Owners Protection Act of 1986, as it would create a "Central Database" of firearm owners. (not to mention various Constitutional issuses.)

That wouldn't violate the Firearm Owners Protection Act of 86 because it is a state law. FOPA only prevents the federal government from establishing a centralized database (and not even that very well given the way the FBI has held onto NICS records).

Don't feel too bad - Texas is pretty gun friendly and we already have four anti-liberty bills just on gun shows alone.

I suspect this is merely a portent of what the year ahead will be like. The antis are renewing their efforts in the face of their election defeat - lets hope that gun owners don't rest on their laurels and remember that the election was only a battle in a very long war.
 
Please read the snippet from the Firearms Protection Act of 1986, it DOES INDEED apply to STATES!

No such rule or regulation prescribed after the date of the

enactment of the Firearms Owners' Protection Act may require that

records required to be maintained under this chapter or any portion

of the contents of such records, be recorded at or transferred to a

facility owned, managed, or controlled by the United States or any

State or any political subdivision thereof, nor that any system of

registration of firearms, firearms owners, or firearms transactions

or dispositions be established.
Nothing in this section expands or

restricts the Secretary's authority to inquire into the disposition

of any firearm in the course of a criminal investigation.

You know I jst realized something else, seeing that it says "State" as in each state, Cali's law for registering ANYTHING firearm related is TOTALLY in violation of the FOPA of 1986! Why doesnt anyone sue them???

Not only does it say "State", "United States", "or any Political Sub-division of", it even states that

"nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established"

So any laws/regulations concering the Registration of firearms, or their owners is TOTALLY illegal (this is of course if they were born after 1986.
 
Dead, I think you just asked yourself a pretty good question.

If FOPA really did forbid the states from registration then how come nobody has successfully sued the many states and localities (Washington DC, California, New York City, Chicago, Detroit, etc.) practicing registration?

Much of California's assault weapon registration was enacted after 1986 (Roberti-Roos was enacted in 1989)and should be prohibited according to your reading of the law.

I'm not a lawyer and I don't even play one on TV; but I think you may have misread that section. It talks specifically about the powers conferred upon the Secretary of Treasury (who has ATF under his juridiction) to enforce firearms laws.

He is forbidden from transferring records, establishing a system of registration, etc. Nothing I read in your link to the act says that the individual states may not establish registration. In any case, I don't think Congress has the Constitutional authority to forbid states from enacting registration.

I wonder if these bills were written by one particular person, or are from a number of different sources.
We should definately do something to make our voices heard on this issue.

Research needed

A current thought I had, what are groups in other states looking at right now. Be interesting how many of them have the same bill's.

Could it be possible that anti-gun groups are sending out this legislation? These look like the same bill's we were fighting last year, so it could just be a re-submission.

I was just looking briefly back into some archives. It seems that many of these antigun bills have been introduced session after session, many by the same Democrat (out of Gary, surprise, surprise). Without exception it seems, these bills are assigned to a committee (usually the Ag, Nat. Resources, Rural Development Comm., I think) and are never heard from again. Unless committee and/or assembly structure, or the political climate in Indiana changed significantly this past election (anyone know?), I don't think there's much threat from the bad bills. Now, let's see about getting the good ones through!
 
SB72 is on the fast track. It's already through the Senate (passed out yesterday 41-8) and in the House.

I remember there was a similar bill in Indiana last year that never made it through. Does anyone know how and why it died? I'm trying to determine whether or not to be optimistic about SB72 and/or its House counterpart or not.
 
Had a wee little chat with Hostettler and John Gregg. Also a small talk with Jerry Denbo(Whom I hopefully plan to oppose next election). Most of the bills mentioned in Indiana are dead in the water so say my political wizards.

Over half are re-intros of garbage that died aborning last year and none are expected to make it out of committees this year. The only two with any real world chance are the info for CCW apps and remotely the raising of age from 18 to 21. However, a recent fed report whining about how firearms purchased in Indiana are turning up in crimes in the Peoples Republik of Illinois *has* gotten some ears perked up. It'll be necessary to keep the heat on these bozos this year until that fades from their shallow little minds.

I believe that SB72s daddy last year(damned if I know what the number was then) simply got lost in the election year/tax squabble shuffle. I don't remember anything specifically killing it except lack of interest/determination.

You mentioned you may oppose Denbo in the next election. Are you referring to the primary or general election? Just curious.
