Another reason why we should stay out of NYC

I return to NYC after moving to AL for a few days. Now yesterday night I went out with a friend of mine. We went to a park to chill and talk a bit, that was when a cop car show up with two cops in it. They asked us what we were doing in the park. We told them we are just there to chill. They looked at us and ask for our ID. We showed them the ID but since he was standing directly on my top right he was able to see my AL pistol permit right next to where i put my driver license in my wallet. He then ask me we have any weapons in the car, I said no. that was the part where it got me. He asked me to step outside of the car. and then went on and search us AND
the car. One of the cop asked me why i need a pistol permit, I told him sir down south your allow to protect yourself :rolleyes:
The NYPD then ask us to sit in the car and went back to their car to check on the computer. Of course it came back clean. :rolleyes: (I know NYC laws so I didn't bring my firearms but of course my gun permit stays in my wallet)

Now from what I know what give them the right to pat us down and search the car like they did? The park close at 9 and we were only there until 9:15. There were a few other cars there but they didn't search those like they did to ours.

Cliff notes: I went out with a friend to the park and got pat down search by cops and then they search his cars too.:rolleyes:

Thanks alot NYPD now I won't go to your city unless I really have to. I'm just glad that I decided to move outta here before.:)
 
Key information: "NYC". Nothing should surprise you about how citizens are treated in NYC. Many NYPD officers have never been exposed to the Real World.
 
I wouldnt go to NYC if I was offered 50 grand to walk in central park after 11 at night.It's a cesspool.The street shops slide down their battered doors and gates. Everyone just vanishes.It's wierd.


They are a fine example of what a nanny state is.Do as I say and not as I do sort of place.Once was enough for me also.
 
So, mete, being in a public park 15 minutes later then a sign allows is justification for a search of yourself and your property?

I have got to stop reading forums. Everyone has gone nuts and I am getting there.

You were in the park after the posted closing time...that alone gave them reason to question you. As for the people in the other cars, did they not search them or not even question them?

As far as the vehicle search goes, I imagine it was largely brought on by your possession of a weapons permit. Did you (or your friend) consent to the search of the vehicle? I would hope that mere possession of an out-of-state weapons permit wouldn't constitute probable cause. Then again, being in the park after close might have been enough; I'm no lawyer.
 
I gotta add that to my reasons for not getting a CWP in the other thread.

But don't take it so hard. You are a big bad criminal for being in the park after hours, after all. Shame on you. Breakin the gestapo curfew is a felony isn't it? Next time, call in on your cell and turn yourself in. THAT's the politically correct thing to do.:rolleyes:

Sounds like you have a lot of first hand experience on life in NYC.
When were you there last, and for how long?:confused:
 
i'n a ny'er and work in nyc everyday. nyc is currently on a high alert and as such their pd force can sometimes be over zealous...... but hey, they're just trying to protect us, and as you know, CP has always been an issue at night..... i'm sure their account of it would have been different than yours, i dunno because i was not there....

anyways, no harm done, but probably a slight inconvenience for you.....

Without his consent to search, which I'm assuming they didn't get, his fundamental rights were violated. How does that equate with no harm?
And yes their version certainly would differ from his, in my personal experience. A cellphone with camera or tape recorder would be worth its weight in gold.

That was a close one - I was just about to move there, but for one last reason not to. :) JK, no they had NO probable cause to search, IMO. Your rights were definitely violated. Are you SURE that you did not *consent* to the search - or did your buddy consent to the search? Usually the cops are pretty slick, by using an "assumptive close" on you when they want to search - they will put it this way - "I'm gonna search your car - you have a problem with that" or "that ok with you?", and say the "I'm gonna search your car" part very authoritatively, and the "that ok with you part?" very quickly and assumptively. You do not EVER have to consent to a search!
 
Of course, the type of agressivce policing in this case is the reason NYC is far safer than places like Houston, Dallas, Anchorage and a lot of other gun friendly places...

As the border patrol told me many years ago
"this ain't a search, a search is when you go into that room, drop your drawers and get your anal cavity probed" thats a search - this is just an inspection.
