Angel Shamaya, founder of KeepAndBearArms.com is in jail in Michigan, having been arrested for possession of firearms not properly registered under Michigan law.

Angel's friends are working to help him with this problem, but we need your help, right now!

We need character references from you for Angel. There is a form letter for you to fill out and send back at: http://www.marbut.com/angel.

Be advised that Angel's problem is happening in the Detroit area, where a strong anti-gun sentiment exists in the criminal justice system. So, we are asking you to downplay gun-rights and gun-related comments. We will NOT deliver to the court any disparaging letters about Michigan or Michigan laws. Stay on the high ground.

Please, download a copy of the draft letter. Add one sentence of personal comment if you wish - no more.

This is for upstanding, legitimate citizens only. So, we want you to add your name, mail address, and phone number to the letter, so the judge seeing these will accept your letter and will not think you are some flake.

You may email your completed letter, either as an attached MSWord (.doc) file, or pasted into the body of your email, either to newslinks@keepandbeararms.com or to mssa@mtssa.org. So we can pick it out from our many other emails, PLEASE make the SUBJECT of your email: "Angel reference." We will see that these letters get to Angel's attorney ASAP.

Please pass this on to your friends for action. We need letters from everyone who knows or knows of, and appreciates Angel.

Personal note from David Codrea: I spoke with Angel at length last night, before this happened. He is a great patriot and friend. WarOnGuns visitors: I have never really asked you for anything. I am pleading with you to support our brother in his time of need. I will be monitoring things as they unfold--if and when we need to help Angel with more than words, I will let you know.

UPDATE:
I just got off the phone with the Oakland County Sheriff to see if I could help in any way with bail. Unfortunately, the attendant told me Angel has not been arraigned yet, so there is no public information they can share, and that the best thing to do would be to call back tomorrow night. I told the deputy he had a good man in custody and to please see to it that Angel was safe.
 
If this guy is a gun rights activist, and broke the law in an act of civil disobediance, then he has gotten his opportunity to test the Constitutionality of the laws, and his personality and character are unimportant to the case.


If he ignored the law because he doesn't like it, then he's a criminal, and guilty.
 
The problem I am finding is that while this report is now on many boards and blogspots, there is actually little real information to be had.

So far, I haven't found a single news source that confirms or denies these reports. Earlier (about noon MST) I checked CCRKBA and KABA and it is not posted in either of those two most likely websites.

Curious, to say the least.
 
I have the feeling that he might have wanted to test the legality of the law. Why else would an activist, who surely knew the law, get arrested or violating the law?

If that is the case, then he has asked for it. If not, then he is pretty ignorant or dumb to have violated the law.
I read and hear a lot of guys talk about not obeying a law that is unjust. Each has that option, but when "busted" don't complain.

I just got off the phone with Angel Shamaya.

He's out.

He's charged with 4 counts misdemeanor possession of unregistered firearms and 1 frivolous, unwarranted, vindictive count of misdemeanor menacing.

I know we all want more, especially with the last charge, but for now, we must defer to Angel's need to protect his legal rights. I know the background of the circumstances, but my advice to Angel is to not make a public statement about that without advice of counsel. Those who know me will trust me when I say that I am convinced Angel has been made a victim here.

Is this the same guy that had trouble last year with fraud and taxes? I remember a gun activist in Michigan having trouble and "disappearing" for several months after he was charged with fraud related to his organization.

Considering your post was made before Angel Shamaya was even officially arraigned, how exactly can you be so sure he is guilty?

If he ignored the law because he doesn't like it, then he's a criminal, and guilty.

Three possible scenarios here:

One is that he's being set up because of his pro-gun activism. The second is that he's testing the constitutionality of a law he doesn't agree with. Third is that he just flat broke the law.

The first is a remote possibility since the courts take a dim view of DA's who file dubious charges based upon manufactured or perjured evidence. The second possibility is more plausible BUT if that's the case, then why all the screaming and hair tearing over the arrest and calling for character references from people who don't even know the guy? (BTW, character references aren't even admissible in court unless the defense brings up the character issue which opens the door for the prosecution to fully explore the character of the accused. Up to and including any "problems" the accused had in grade school or "habits" that the accused has. It's something that can go wrong very very fast unless the accused is the virgin mary. And even then there's the possibility of a bad character decision.)

Last possiblity is the most logical based upon the perceptions and sketchy facts. Activists are not above the law. However, too often we see activists whose acts are so extreme and which are so often involked that these activists often begin to believe that they occupy a higher plane of existence. Once that occurs they quickly transform into inmates of one form or another. Personally I think it's the celebrity status that does it as hollywierd has the same trend and problem.

At this point I'll reserve judgement as I do not know the guy. I do wonder at the ability of the cops to raid his place and find the illegal weapons. How, why, where, etc on the warrant would be interesting to read and discuss. As would the transfer history of the weapons.

I doubt that. He would have had legal counsel lined up beforehand, and there would not be this call for help.
 
Of course there is a "fourth" possibility. Does anyone here know each and every one of the roughly 20,000 firearms laws that can be violated? Local, state and Federal?

Are innocent men never persecuted or prosecuted in this nation? Blind belief in .gov as a benevolent, even handed societal "partner" is folly.

Angel is a well known quantity. Yes he's an "activist"....but hardly an outlaw. Since when did "activist" in the area of civil rights become a dirty word?

"Pellet guns are considered firearms in Michigan and thus are regulated by the above provisions. A pellet handgun must be registered and requires a license to purchase. In addition, a license to carry must be obtained to carry concealed or in a vehicle; if it has no serial number, the gun must be taken to the State Police who will stamp a number on the weapon. No person under 18 years of age may possess or use a BB gun beyond the yard of his home unless accompanied by a person over 18."

Angel is an innocent man. I know that because he has not been convicted of anything relating to this incident. Hell, he hasn't even been arraigned yet and alreay WA has him doing time... WTH?!?

I don't disagree with your statement, but I disagree greatly with its timing. Now is the time to stand behind Shamaya, not run and hide from supporting him because he *might* have violated some obscure or unconstitutional law that has NO victims!
 
I'm a little unclear on the concept of sending "He's a great guy, Your Honor!" letters. He's charged with a crime. All the "good character references", or bad ones, in the world should have no bearing on this whatsoever. They should have some slight bearing on bail, but that's about it.

Further, I have an issue with "So-and-so has been charged with crimes. We want you to put your name on something saying what a great guy he is... but we aren't going to give you any information on the circumstances surrounding this issue".

I certainly do wish him the best of luck, but I find it difficult to believe he just got caught unawares.
 
I did a google search on him and he seems to be a respected person within the 2A community. The letters were probably for bond purposes and a show of public support also. If it is a case of a wizzing contest between him and some public official. I imagine the web request was the quickest way to get the FYI out to folks that know him.
