Cyveillance Surfs In Search of Unauthorized Content Use
The Associated Press (AP), with more than 6,800 television, radio, and newspaper members, wants to make sure its content is not being pirated on the Internet.
So the AP has hired Cyveillance, the Washington, D.C.-based e-business intelligence firm, to track down unauthorized online use of its content.
"Managing valuable proprietary content on the Internet is becoming increasingly difficult for companies to do by themselves due to the sheer volume of information on the Net and the rapid proliferation of sites," said Brandy Thomas, CEO and chairman of Cyveillance.
Cyveillance will provide its 'Extra-Site' e-business intelligence services to the AP by surfing the Web in search of unauthorized publishing of AP content. Cyveillance uses its proprietary NetSapien software to analyze the Internet's pages.
Newspaper Web sites also have been subject to other sites stealing their content. Often, their course of action entails a cease-and-desist letter, but such recourse can only be used once the stolen content has been tracked down.

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright [emphasis mine]. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
