AK-47 illegal?

Are AK-47's illegal? I was listening to these kids that go to my school talk about how AK-47's are illegal and one of them said that they aren't illegal and there dad has one legally.
Is this true? Thanks
 
It all depends, most of the "AK"s you see are really semi-auto reproductions (made in the same countries, and in the same factories as 'real' AK's and AKM's.

If a real, fully automatic AK or AKM was imported prior to the cutoff date and legally registered with the BATFE then it's completely legal, so long as it's possessed in one of the 38(?) states that allow one to possess fully automatic firearms.

Some states also prohibit certain weapons based on cosmetic features; really a beauty contest for rifles, if you are an ugly, black rifle you probably wind up on the banned list.
 
Yeah, semi-auto rifles that look like AKs are currently ok without any special paperwork. Machine-guns (real AKs) need to have been registered since before 1986, have a $200 tax stamp, and the owner has to pass an extra background check, then they are legal, but there are so few of them around that the prices are silly. Probably $50,000+ if you can find one for sale.

And when Obama talks about "AK47s", he means the fake semi-auto versions that are no different than a million less mean-looking hunting rifles. It's all about appearance, not substance.
 
no new real AK 47s have b sold in this country since 1986 unless it went to the us govt or one of its agencies. There are alot of smi auto verdions out ther though.
 
Machinegun registration in the U.S. has been required since 1934, long before there were any AK-47's. A ban on further machinegun registration was enacted in 1986, so any machinegun not registered prior to that would be illegal.

Since most of the news media is both anti-gun and ignorant of guns (the two go together - we fear what we don't understand) they usually call all semi-auto rifles "machineguns", hoping to frighten the public into supporting more gun bans, and backing more government and police control over the people.

Technically, full auto AK-47s would have had to been imported and registered prior to the 1968 Gun Control Act which cut off the importion of machineguns for civilians. Anything after that date would have to be a conversion of a semi-auto.
 
Regardless, to most of the press, any gun remotely shaped like an AK-47 is at least an "assault rifle" and probably "a machinegun", owned only by insane fanatic fascists who slaughter little children and plan to blow up the world unless they are stopped by MacGyver with his Swiss army knife.
