ACLU backs man/boy sex group in suit

BOSTON ( Court TV) — The American Civil Liberties Union (ACLU) will defend an organization that advocates sex between men and young boys over claims that the group's Web site incited the murder of a 10-year-old boy.
The ACLU announced it will represent the North American Man/Boy Love Association (NAMBLA) in a suit filed by the family of young murder victim Jeffrey Curley.
Curley, of Cambridge, Mass., was killed in 1997 by two men who smothered him and dumped his body in a river after he rejected their sexual advances.
Charles Jaynes, one of the convicted killers, reportedly viewed NAMBLA's Web site — which has since been taken offline — shortly before the murder and had NAMBLA literature in his possession.
Jaynes, 25, is serving a life sentence with the possibility of parole. Salvatore Sicari, 24, also convicted of Curley's murder, is serving life without parole. The Curley family won a separate suit against the two men last week. A superior court jury awarded the Curleys a $328 million judgment against the killers. While there's little chance that the family will ever see any money from the convicts, the verdict was a legal victory for victims, exhibiting that criminals can be held civilly liable for their crimes.
NAMBLA's main goal has been to abolish age-of-consent laws that classify sex with children under the age of 16 as rape. The group reportedly supports the belief that boys are capable of determining whether to have consensual sex with an older man by age 8.
However, NAMBLA members call themselves a political advocacy organization and say they do not advocate coercion, rape or violence.
John Roberts, executive director of the Massachusetts ACLU, says his organization will defend NAMBLA based on free speech guaranteed by the First Amendment. "It has to do with communications on a Web site, and material that does not promote any kind of criminal behavior whatsoever," Roberts told the Boston Globe.
The ACLU will act as a surrogate for NAMBLA members, allowing them to remain anonymous in court. Additionally, they will attempt to block any action seeking to disclose names of NAMBLA members. Since Curley's murder, many NAMBLA members have sought privacy in fear of retaliation.
