AB35 in California.....?????

My reading of this is that you 'might' get an LEO to issue you a 'handgun license' or you might not. It's also handgun registration, ala New York City. AND you will be required to register ALL your handguns, whether you have a license for that particular handgun or not. And you will have to reregister EVERY handgun EVERY year. At some point, the LEO's or legislature will no longer allow you to reregister you handguns and then you will have to turn them over to LEO or state agency you are told to. Can you say handgun confiscation coming to California in the next four years???

"The bill would require the department to issue a handgun owner's license, valid for 4 years, to an applicant if the department determines that the applicant is not prohibited from obtaining the license. The bill would require an applicant for the license to perform safe handling and shooting proficiency demonstrations and to pass a written test, as specified.

The bill would require every licensee, as a condition of the
handgun owner's license, to register with the department every handgun owned by the licensee within one year of issuance of the license and to reregister each handgun annually thereafter. This registration requirement would also apply to each handgun purchased by the licensee after licensure. The bill would require the department to maintain a current data base containing all of the information submitted by each applicant for a handgun owner's license and a registry of all handguns registered by licensees.

The bill would make it an offense, punishable as an infraction, for any person to possess an unregistered handgun in his or her residence, and would provide a 30-day period for the person to register the handgun. The bill would provide that failure to register the handgun under that circumstance would be a misdemeanor, and permit the confiscation of the handgun until it was registered. The bill would also provide that possession of an unregistered handgun in any place other than a person's residence is a misdemeanor, and that the handgun may be confiscated and held until registered. In addition, in that circumstance, the person's handgun owner's license may be suspended or revoked."

All you handgun owners in California ARE SCREWED!! IMHO.
 
This bill would require any person who seeks to purchase any
pistol, revolver, or other firearm capable of being concealed upon
the person to obtain a handgun owner's license issued by the
Department of Justice. The bill would require the department to
develop and make available a handgun owner's license application
form. The bill would require an applicant for a handgun owner's
license to provide specified information under penalty of perjury.
By expanding the scope of the crime of perjury, the bill would impose
a state-mandated local program.

THIS is the part I was asking about. It does not mention possessing guns. It mentions PURCHASING.
That's why I asked. It does not appear to apply to keeping what you have. It appears to get the registration started on the PURCHASE of a handgun.

Hi Lavan,

You are correct. If you don't get
the license, you don't have to register your
existing guns or pay the annual fee. However,
without the license, you will never be able
to buy another handgun.

In essence, one purpose of this bill is to
retroactively register handguns in the state.
Note that some time in the past (I'm not sure
when), the state started registering new handguns
at the time of purchase. However, that still leaves
lots of guns bought before then that they don't
"know" about. So, now this bill comes along and
says, "if you ever want to buy another
handgun, you have to register all the ones you
currently own and pay an annual fee for the priveledge"

I say, KMA!. I am buying what I want now. I will
never get this license, nor pay annual fees on
my guns. Also, as pointed out above, the bill as
currently written, leaves the testing up to the
discretion of the local police. Talk about ripe
for abuse!!

If there is anything you want, get it soon. I expect
prices to rise once this passes and word gets out.
Note that this bill passed (as AB273) last year,
even after the sponsor received in excess of 10,000
(yes 10K!) phone calls opposing the bill. AB273
was withdrawn at the last minute under pressure
from Gov. Davis, who feared an election backlash if
it passed. He has indicated he is willing to sign
it this year. Note also that the Dems GAINED seats
in both state houses last month, which is why I'm
saying we can't stop it. Not that I won't try, but
it looks grim.

We need to get better organized this time. There were about 15k calls that were made against it. It means handing out fliers to people at ranges, store, and gun shows. We should be able to get over 100k calls this time.

Don't forget AB22.

100K calls is pretty optimistic. I think the
CA Rifle & Pistol Association has around 60K
members.

I find most folks out here don't care about gun
rights. I know a couple of people who own a gun
or two and who even go to a gun show occasionally,
but they won't lift a finger to call or write
their legislators. Only about 25% of households
out here own a gun, compared to 75% in Texas,
where I use to live.

Remember also, this is a state that went big for
Gore and Nader. Lots of folks out here are very
superficial, highly emotional, and easily
duped by politicans and the media. I received
a political mailing that pictured full-color
photos of an AK-47, along with words to the effect -
"My opponent and the NRA want to put these in the
hands of criminals and children". This kind of
hyper-emotional (and untruthful) nonsense is
offensive to me, but obviously works on people
out here or it would not have been sent.

Lastly, even after the slew of gun control laws
that passed in the last 2 years, democrats
gained seats this election. To me, this
indicates the majority out here are either in
favor of gun control or at best, don't care.

I hope you are right, but again, I'm not optimistic.

I don't know much about AB22 and I'm afraid to find
out! I think it is an attempt to put small FFLs out
of business, but I haven't read the bill yet. Also,
who know what else is in the works that we don't know
about yet. Sad.

SO, if you have an unregisterd handgun(s) in your possesion at home, you will be charged with a misdemeanor, taken to jail and your handgun(s) confiscated. Does anyone really believe that your handgun(s) will be returned to you AFTER you register them??? And, consider this. While they currently say it's a misdemeanor, they will probably change that to a felony. You would then be considered a criminal who can't own a firearm any more. So, if don't register your handguns, you do risk possible jail time. NEVER tell anyone you have a handgun (past, present or future), because sure as God made little green apples, someone will nark you out to the gun gestapo. And bury them deep before they come to confiscate them.

When gun confiscation starts, the government will FIRST go after all licesnee's. Then they will start perusing previous sales forms to 'track down' all those nasty, illegal owners of handguns. THEY WILL get your handgun in the long run, if you live in Ca. I restate my previous premise. Handgun owners in CA are screwed. Long guns WILL be next.
 
CRPA has about 64k members and the NRA has 10% of it's 4.5M members located in the PRK, or about 450k members. I expect that little orange post card mailing again, like AB273. It would be nice for CRPA to place something in it's FiringLine paper. 100k is a conservative estimate. Even with 100k+ calls, the socialist democrats will still push it through. When describing this bill CRPA believes Gray Davis, a conservative democrat, is our only hope.

I purchase all of my mean rifles last year and all the handguns that I might want in the foreseable future during the last six months.

My strategy is to be politically active, obey the law and if necessary, move my guns out of state, followed by my body moving out of state.

Hopefully, we will get some guidance from the U.S. Supreme Court regarding the constitutionality of these laws. I'm not greatly hopeful in that the USSC seems to straddle the line with their decisions.

It is very gratifying to see the electrical disaster taking root in California. Conservatives have warned of this for years. You can't bring in 500,000 immigrants per year and not build power plants. The Eco-Freaks and gun grabbers can expect the lights to go out and the BG's to enjoy the liberal ways of this crazy place. All we need is an economic downturn and crime rate will be on the rise. Not wishing for bad things to happen, but sometimes a reality check is good for the political climate.

You're right. I forgot about all the NRA members
out here - duoh! We could indeed generate a
lot of pressure, but I agree it will make it to
Davis' desk anyway. He's considered a "moderate"
Democrat, but will be under tremendous pressure
from the liberal faction and the media to sign
the bill. I think he will - "for the children".

Other states have gun-owner licensing, although
none impose as many requirements as AB35. I don't
know if court challenges have ever been mounted in
those states, but obviously, the schemes are still
in place. I doubt the USSC would get involved and the
CASC will be of no help either. Agree with Wallew -
we are SCREWED!

I'm with you. I've been buying stuff I think I
might want in the near future. Long term, the
only real solution is to give up shooting and collecting
as a hobby or leave the state.

Don "pistol-packing" Perata (or one of his ilk)
has stated publicly that we (gun ethusiasts) are
basically not wanted here. It sucks, because I love
San Diego and all my family is in southern CA (which
is the reason I'm here in the first place).
