A while back I posted a note of support for you folks in general and SSAA in particular.

Since then, I get an occasional blanket email from this guy detailing his gun problems. The insurance cancellation is a new twist, to me anyway.

Have you all heard anything about this?

CAR INSURANCE REFUSED BY RACQ FOR WEAPONS OFFENCES

I have been a member of the RACQ since 1976.

I am a GOLD CARD member and subject to a LOYALTY discount on my insurance. I have only made one claim on any policy where I was at fault- about 10 years ago I damaged 2 doors on another car in a car park. I have had no traffic offences of any type for about 10 years.

When I went to renew my Third Party Insurance I disclosed (as required) that after court appearances in the HIGH COURT I had been convicted of the offences of unlicenced possession of weapons.

These weapons were 2 AIR RIFLES and 2 non-functional BOLT ACTION .22 cal Rifles. This was part of a political protest against the recently introduced GUN LAWS. I have not been convicted of any other criminal offence ever.

I also notified the RACQ that I was due in court on the 5 October 2000 on another weapon - being a STOCK and nothing more.

BOTH MY INSURANCE POLICIES WERE IMMEDIATLEY CANCELLED AND I AM BANNED FOR 10 YEARS
I realise that the RACQ has the right to refuse insurance to people with criminal convictions however the issue of my gun offences has nothing to do with my suitability for insurance.

It does however seem to be part of an insurance industry oppression of gun owners.
Locally a Gun Shop owner cannot get public liability insurance, fire or theft Insurance. A local disposals store had its insurance cancelled after many years because they stocked ammunition. Neither had committed ANY offences.

If I have disobeyed the law it is up to the courts to decide the penalty- I am currently doing community service at a local school for my offences.

If I had committed some type of insurance related offence I could understand a refusal of Insurance. I have, however, been a long term member of the RACQ with a good record.
When I approached another Insurance company about Insurance I informed them that you had refused to re-insure me and they likewise refused to insure me.

On 27 Sept 2000 I contacted the RACQ again and spoke to Peter Starkoff a manager at the business centre of the RACQ- pstarkoff@racq.com.au but he has also refused me insurance.

It would seem that "loyalty" is simply a RACQ come on to encourage customers. Loyalty is not something that the RACQ itself offers. Instead you offer further penalties to that of the Judge on the basis of "Policy" irrespective of the relevance of the offence to commercial decisions.

I request that you repeal the RACQ Insurance decision to cancell my insurance policies.

I know of Martin Essenberg and his fight for what he sees as justice. Personally, I think he pushing sh*t uphill, but that's another matter.

The insurance bit doesn't surprise me at all. Insurance companies are very leery of firearms; some won't insure them, others require an additional premium, and others require additional security features on your home, such as a 24-hour monitored burglar alarm system

Martin has also achieved some notoriety in Queensland. Perhaps the RACQ, a rather staid organisation, is using this as an excuse to distance themselves from him.

If you have been refused insurance by any company, it is highly unlikely any other reputable insurer will take you on either. And the applicant has a duty of disclosure which means even if they do insure you, and you claim, and they investigate and find you lied -- you're up that well-known creek in a barbed wire canoe with no paddles.

Knowing some of the fine print in my policies, I doubt he has any redress.

Yes Oatka ...we know Martin well and all his many valiant but largely futile struggles.
I agree with Bruce on this, I am afraid. Aussie shooters have the stuffing beaten out of them and are cecile and apathetic.
It is cruel but fairly common to sharply discriminate against firearms owners over here, in so many ways.Thus we are rather secretive -even to stickers on our cars and letters to newspapers etc.
I am also afraid that Martins mental health may well suffer in a just cause the aussie shooting association have washed their hands over - very like the infamous Pt Arthur massacre cover-up/incompetance... maybe.

Glad he only got community service...in NSW it would have been 14 years hard labour and a fine.

Never knock another's different shooting interest or discipline...REMEMBER we are all but leaves on the same tree of freedom.
 
Thanks, gentlemen, a sad story, on a couple of levels. More anti-gun fodder (insurance prejudice), if that's any consolation :( .

I checked out the assaultweb board and it looks like Old Home Week - TFL type board. Looks like lots of Yanks there. I've registered and will be sounding off from time to time.
