A few questions about gun laws

hi all,

I'm a new member and this will be my first post. First an introduction. My name is Rick, I'm 24 and live in Ohio. I am a fan of Semi auto firearms and bolt action rifles. Currently I own only a few guns, ak-47, Ruger .45 acp, .22 marlin bolt action, and a few shottys.

I apologize if its in the wrong forum or if these are stupid questions. I've only recently started aquiring firearms. I have been searching for days for answers to the following questions. What I would like to know is:

When purchasing a used gun from an individual, must it be registered under the new owner (me). I asked a local gun shop and they told me that the gun is yours to do whatever you wish with it (sell it) You don't have any legal obligations when selling or purchasing a used firearm. (doesn't sound right to me) I've purchased a few guns from individuals and gun shows and was just wondering what the law is on that type of situation. When I purchased a rifle from a local gun show, the dealer didn't ask me for ID or anything of the sort. I handed him the $ and he handed me the rifle and I was off.


When transporting a gun from home to shooting range, what is the proceedure. I normally put the gun in the trunk and the mags/ammo in the glove box and lock it. However I went shooting today and my fiance' took the car. I was stuck with the truck. I wasn't sure what to do first off b/c my glove box doesn't lock. I just put the rifles on the seat and the ammo and mags in the glove compartment b/c it was raining. Had I been pulled over would I have been in trouble for transporting them wrong?

Thanks in advance for any help and remember, I'm new to this world, I don't know everything about firearms and firearm laws. That's why I'm here, to learn. Hopefully I will be a new longtime member. :)

Sec. 2923.16.
C) No person shall knowingly transport or have a firearm in a motor vehicle, unless it is unloaded and is carried in one of the following ways:

(1) In a closed package, box, or case;
(2) In a compartment that can be reached only by leaving the vehicle;
(3) In plain sight and secured in a rack or holder made for the purpose;
(4) In plain sight with the action open or the weapon stripped, or, if the firearm is of a type on which the action will not stay open or which cannot easily be stripped, in plain sight.

Note that some municipalities have additional restrictions.
 
Thank you for the reply and link. I read alot of the link you sent me but it seems to only deal with concealed carry. I will read deaper into it and visit the links they have listed but I think what I'm looking for is Ohio's gun law's in general. Also I do not have a CCW license yet. Also another question I have is: Say I'm going to the range and I'm stopped by State patrol. I have firearms in the trunk and mags/ammo in glove box. Must I notify the officer I have the firearms?

You have to tell them right off, unless the gun is on you, which would be illegal in a car, but legal walking down the street with a CCL, but a lot of the time they will ask if you have any weapons, and then if you lie, you can get arrested.

Hi Rick! :) Whereabouts in Ohio are you? I live in the northeast part of the state but regularly visit central and SE Ohio.

It is right. In Ohio there is no state-level registration of firearms whatsoever. If you live in a city, you should check your local laws to see if there is a registration requirement.

First of all, the person you bought the rifle from wasn't a dealer. He was a private individual selling from a table. It doesn't matter if you're at a gun show, in your garage or standing in a parking lot; you took part in a private transaction. All federal and state laws apply at gunshows just like everywhere else. If the person who sold you the rifle had a Federal Firearms License (FFL) and didn't check your ID and didn't have you fill out the yellow 4473 form, he'd be in a mess of trouble with the Feds.

Depends on the officer who stopped you. Technically, if you are able to access both the firearm and the ammunition without leaving your vehicle, you are in violation of state transportation laws. When I drove a pickup, I would put the ammo in a watertight container and leave it in the back. The guns would ride in the cab with me. When I stopped somewhere, I would put the ammo in the cab and lock the truck; then put the ammo back into the bed when driving again.

Can you cite the law you are basing your comments on, tel0004? I believe that some of the information in your post is inaccurate. AFAIK, a citizen has no duty to inform an officer of the law that there are firearms in the trunk unless specifically asked about weapons. If you have a CHL in Ohio and are armed, you are obliged to inform any LEO that you encounter in an official capacity that you are a CHL holder and are armed. Other than that, there is no reason (legally or ethically) for a citizen to volunteer information that is no business of the officer making the stop.

Thank you much TheBluesMan, I found those answers to be very helpful.

I just recently moved to Marengo Ohio. I used to live in Delaware. I shoot @ my parents property in Delaware county and also a state range on route 229.
