I guess it doesn't pay to try to rob senior citizens anymore.

I hope the old dude doesn't find himself facing charges later on for killing unarmed thugs.
 
Thankfully we have castle doctrine in PA and the thugs won't be able to sue in civil court.
Most castle doctrine laws don't have any effect in public places like a bike trail.

I'm not familiar with PA specifically, though.
 
Yes, I'm pretty sure if this were to be litigated, it would be a standard self-defense...defense.

In the elderly man's favor, the DA requested his release and the wounded perp was arrested.
 
As I understand it a perpetrator would have to display intent, opportunity, and ability to cause death or serious injury to justify firing in self-defense.

Just my two cents worth.
 
Sounds like his case met all the criteria of imminent threat of grave bodily harm or death, opportunity and jeopardy all in one basket. Who knows what these creeps would have done to the man by himself if he was not armed. My 80 yo mother rides her bike for long runs out in remote trails in MA. She doesn't carry, nor have the right to carry in MA and I would fear for her life should the same situation happen to her. Sad to see loss of life, but shucks, the man has the right to self defense.
 
Might even get the 2 accomplices locked down for life... Little fellers fergit to realize these other implications they can face when they think no one is gonna get hurt...

And, your understanding is generally incorrect. The test in most jurisdictions is the "reasonable person" test - would a reasonable person, in the shooter's shoes, have a reasonably articulable fear for his life or that of others. It's a vastly different standard.
 
I'm not seeing the L&CR relevance, and this is cross-posted to General Discussion.

Given the rather morbid character of some of the posts here, I won't be merging the two threads. We don't cheer for people being maimed or killed, even if they are bad guys.
