I went to your website and I have 4 opinions on the subject:
1) Your chief complaint with the "defective warrant" is that there's a typo in your birthdate? Other than that all the factual evidence sufficient for the warrant is correct?
If so, then you have no legal leg to stand upon. Yes, the warrant was defective. Does the defect materially affect the premesis to be searched? No. The location of the search, the items to be searched for etc are all proper in the warrant. Were you present during the time of the search? Apparently not and thus had no need to be named or described in the warrant. Thus, the defect in the warrant fails to cause the warrant itself to be illegitimate or unlawful. Note also that there is no requirement for the homeowner/resident to actually be presented with the warrant at the time of the entry. Only that the warrant be signed and issued (look up telephonic warrants if you don't believe me) at that time.
2) Your guns were confiscated and you were charged with a crime. The fact that you were not found guilty of the charges is immaterial as affecting the confiscation of your firearms. They were seized and you were charged; that's the way the legal system works in this country.
However, since the weapons WERE confiscated from a licensed collector 2 issues arise. The first is whether the warrant and criminal charges revoked your collector status/permit. If so, then the weapons couldn't be returned to you legally so they had to be destroyed. Secondly, if you actually were in front of a judge who promised you that you'd get your guns back then I KNOW that the DA didn't dismiss the charges and attempted to prove sufficient facts to bind you for trial. The fact that the judge didn't agree with the DA on this doesn't make the charges evaporate and the weapons couldn't be returned to you.
If the reason you were in the courtroom was for the hearing to get your property returned and the judge OK'd and signed the order for the return of the property and THEN it was destroyed, you'd have legal recourse against the polity and individuals responsible for the destruction. Since you haven't described or alluded to such I assume such doesn't exist and that nulllifies this possibility and enhances the likelyhood that you were in court on the basis of the charges levied against you.
3) If you have actually spoken to an atty in this matter as you say I highly suspect you haven't retained him based upon the types of stmts on your webpage. I believe that had you actually retained an atty's services you'd have discovered that either you'd have gotten your guns back by filing the proper forms and going to the hearing, OR you aren't elegible to have your property returned to you for various legal reasons.
4) Thus, your webpage appears to be one loud sniveling whine about how you were wronged and leaves out all the factual stuff about how/why the cops/legal system did what they did. I have no sympathy for you since you appear to have done this to yourself and are now trying to shift the focus and blame onto someone else.
