5 FACTS ABOUT THAT FLORIDA COUNTY

1. Claim: 19,000 ballots were thrown out because voters selected more than one candidate for president. This shows people were confused and a revote should be taken.

2. Claim: The ballot was illegal because Sec. 101.51 of the Florida Statutes provides that the box for selecting a candidate should appear to the right of a candidate's name. Since the square for punching the computer ballot for Buchanan appeared to the left of his name (he appeared on the right side of the so-called "butterfly" page), the ballot does not comply with Florida law and some legal redress should be given.

Fact: Sec. 101.151 does not apply to the Palm Beach County procedures. Sec. 101.151 provides in pertinent part: "101.151 Specifications for general election ballot-- In counties in which voting machines are not used, and in other counties for use as absentee ballots not designed for tabulation by an electronic or electromechanical voting system, the general election ballot shall conform to the following specifications:......."

"Electronic Voting Systems Act". This Act was first adopted in 1973 and has been amended frequently since then. 101.5609 Ballot requirements.--

(1) When an electronic or electromechanical voting system utilizes a ballot card or paper ballot which is distributed to electors, the ballot shall meet the following requirements:

Section 6 (6) “Voting squares may be placed in front of or in back of the names of candidates and statements of questions and shall be of such size as is compatible with the type of system used...”

3. Claim: 3407 Palm Beach residents cast their ballots for the Reform Party candidate. Gore allies like Rep. Robert Wexler charge that those votes rightfully belong in the vice president's column. "These people are mostly elderly Jewish retirees who would never be caught dead voting for a Nazi like Buchanan," Wexler told reporters Wednesday. Even Buchanan has said those votes don’t belong to him.

Fact: In Buchanan’s 1996 presidential primary, over 4,000 area residents voted for Buchanan.

4. Claim: Proof that the votes for Buchanan were in error is that he received 3407 votes in Palm County while a similar county , Broward, gave him only 790.

Fact: According to the Florida supervisor of elections, Broward County has only 189 members of the Independent Party – Florida's Reform party. Palm Beach County, on the other hand, has a whopping 14,551 members of the Independent Party. In fact, it has the highest Independent registration in Florida. So as a percentage, Buchanan got almost 7 times the registered independent vote in Broward will getting only 18% of the independent vote in Palm County.

5. Claim: The ballot was confusing and is part of a Republican dirty trick campaign.

Fact: It was designed by a Democrat. It was approved by the local Democrats. It was posted in the local newspaper and in other public places. Every single registered voter in Palm Beach County was sent a sample ballot. Number of complaints reported to the local election officials before Election Day = 0.

Thanks for the info. The FACTS are good to know, because the media gives us very few of them.
They already had me convinced that the 2 claim was legally true. Apparently that claim that those votes are illegal is another sleight of hand.
And, fact numer 4 just about settles the dispute. Buchanon easily could have gotten that many votes.

Each afternoon I listen to the Chuck Harder show broadcast from White Springs, FL. I have listened to him for a long time and find him to be truthfull and rather impartial. He said today that the ballot in Palm County was in the paper and also mailed to each voter in the county well before Tuesdays election. Someone in that county is not doing their home work.
 
Your points are good - for rationally minded, honest Americans. But the *facts* don't matter here.

What we have are two different ideologies in conflict, one of which will do anything to win. The Dems have proven in the past that, regardless of the law, they will twist the "facts" into whatever they want them to say.

I don't mean to sound like a doomsayer here, but when this conflict in Florida arose, and given the historical behavior (corruption) of the Democratic party, Bush has already lost the election.

Re: item #2 (legality of ballot)

I've looked at both statutes that apply here, sec 101.151 and 101.5609 and yes, 101.5609 is applicable as far as the placement, left or right, of the choice. The only sticky point I see is that 101.5609 (2) says: The ballot information shall, as far as practicable, be in the order of arrangement provided for paper ballots. Ballots for all questions or propositions to be voted on shall be provided in the same manner and shall be arranged on or in the voting device, if necessary, in the places provided for such purposes.

If you go back to 101.151 to determine the order of arrangement for the paper ballots, 101.151(4) says: (4) The names of the candidates of the party which received the highest number of votes for Governor in the last election in which a Governor was elected shall be placed first under the heading for each office, together with an appropriate abbreviation of party name; the names of the candidates of the party which received the second highest vote for Governor shall be second under the heading for each office, together with an appropriate abbreviation of the party name.

Technically, Gore's name WAS listed 2nd as required by 101.151 (4) but the punch hole was not. However, on its face the ballot seems to be legal per the letter of the statute. Plus, 101.5609 (2) provides some discretion when it says "as far as practicable." All in all I think the thing is legal, but you can bet that Gore's whores will be arguing what I just posted above.

From what I keep hearing, according to Florida law, no protests about the ballot design or type can be made after the election. Everything is agreed to before the election by both sides.

That may very well be true. I don't know if there is another statute that trumps the ones I mentioned. I was just addressing the debate over the "illegality" of the actual design that seems pervasive in the news.
 
I thought that it was the job of ABC, CBS, NBC and CNN to give us the facts. Now I'm really confused? Isn't this about mean Republicans killing babys and burning them with Gore ballots stolen from the election boxes?
 
Not that I doubt it, but I'm still waiting on a source! I want to be credible and not resort to spreading misinformation if I can help it. I don't need to sink to the level of a liberal....
 
Fact 5. On Fox News today Carl Rove showed a judicial ballot from Chicago - it was the same type (butterfly) that the dems are whining about in Florida. (Newt Gingrich had a great line tonight - "It is the height of irony when Bill Daley talks piously about voter fraud considering his family history in Chicago.)
