49 year old gun & C&R ???????

Hi everybody

I have a C&R FFL I found a gun the is 49 years old & NIB.. Do I really have to wait until January to buy this gun? My first post..

Thanks in advance..

You can still buy it, you just don't get any C&R benefits, ie: is it out of state? Also, confirm whether it's on the ATF's list despite not being 50 years old. What is it?

Yes out of state.. Shotgun.. Check the list twice can't find it..

My big problem is I would have to sell all of my C&R guns to get this 1 gun.. If I can't put in my book then I haven't better my collection..

Why can't you buy it now? If you can't buy it as a C&R, you will have to have it sent through a dealer and pay a bit more, but if you want it as badly as you seem to, that should not be a very big concern. Why is your book important? I know many collectors who have C&R FFL's and quite a few who do not. A collection is a collection, whether any given item is a C&R or not.

Unless you can put it on Layaway until Jan. 1st, just buy it now. Sell your car and get a $500 beater to drive to work for a year. It's a gun! Priorities must be observed.

I have never known anyone to put a gun on layaway awaiting it becoming a C&R, but I have known a number of 20+ folks who used layaway until they became old enough to buy. Many (most?) dealers seem to be willing to do that as long as the layaway period is under six months and some will go up to a year.

Great idea Jim.. My FFL dealer might hold it for me also..

almost forgot.. The book important because I would have to sell all the guns in it to buy a non C&R gun.. Your not supposed to do that.. Got a couple of ARs to sell that should do the job..

C&R licensees are licensed for the primary purpose of acquiring, not acquiring and reselling, curio firearms. BATF might look askance at selling, say, a dozen logged C&R firearms at once and think you had gotten into the reselling biz, not the collecting biz.

Who knows today, but in the past BATFE was not concerned about sales as long as the 03 FFL wasn't routinely selling to non-licensees. Selling guns you own to improve your collection is perfectly acceptable if you offer reasonable evidence that that is what you are doing.

It would help if many or most sales were to other 03 FFL holders.
